You are right. But one question I have is, did she object? Did she reply back with a "lol" text or something of the kind? Did she ever indicate that she didn't want to be contacted? We've never seen her texts in return. Given that she says she won't press harassment charges, I'm beginning to think she may have been a willing party for a while and to a point. Oh I agree, and in all likelihood a criminal charge would bring these issues to a judge or jury. However, the law is generally not concerned with the sensitivity/reaction of a given victim (at least not criminal law). A crime is a crime. To stay consistent with the example, if a guy exposes himself to a girl on the street and she laughs at his pecker, snaps a photo, shows it to her friends, recants the story, etc. etc., he has still committed the crime.

Another point is, people are usually mistaken when they equate "pressing charges" with a charging of a crime. By the black letter of the law the only person who can decline to press charges (criminal) is the District or States attorney, the victim cannot give the green or red light. In practice it is often impossible for the DA to press charges if the victim is non-cooperative (i.e. what people call declining to press charges). In a high profile case such as this where most of the information is already public, a DA can often successfully prosecute without the testimony of the victim. And it should be noted that there are dozens of fresh faced DA's out there who would love to put this case on their resume.

I think you are missing my point here. If Jen and Brett were texting back forth (and at this time we don't know that she wasn't texting him in return) then there might not be any crime to charge Brett with.

Put another way, what if they had exchanged texts messages, some suggestive (without pictures) and Jen texted something like "Well, what's in it for me." If he responds with a picture of his cock, has a crime been committed? Likely not. It's certainly not like the example of the guy flashing on the street corner. At this point, we only have of one side of the conversation and a bunch of speculation that Brett is a pervert. It fun to attack Brett. The prima donna has it coming right? Jen's unwillingness to come forth with this originally and now remaining silent so far speaks volumes.
