In most jurisdictions, these defenses don't work. The court analyzes whether anticipation of sex was a component in the transaction. 99 times out of 100, the court rules that anticipation of sex was a factor in the transaction, and thus it is prostitution and illegal. If you don't testify you're gonna lose. If you do testify, prosecutor can cross examine you. Prosecutor could just ask, "How many times have you paid an escort where sex was not involed?" Your response is "never." Is sex involved every time?" Your response is "yes." "Did you anticipate sex with this woman?" your response is "yes." Well that looks like sex is component in transaction.

besides the system is built towards making a deal in usa. if you plead guilty you might get close to minimum depending on previous record. your lawyer could work out plea deal where you get little or no jail time, and/or a fine. If you plead guilty you might get 0 jail time or like 5-10 days or something, or maybe just a fine if first offense. If you go to trial and lose, they could give you up to 12 months. thats the max so they prob wont, but you might get 3 months or something... its a gamble. if you plead guilty you might only get fine/community service/few days in jail, whereas if you go to trial to try to make that defense, if you lose you could be looking at 1-3months behind bars. If you have valid defense, it is worth the gamble... getting it erased and off your record is worth it... but going into court trying to say that sex was not a component of the transaction (when it obviously was)... the judge will just laugh at you and find you guilty. they're not stupid. they weren't born yesterday. Anticipation of sex is obviously a part of the transaction. judge knows the deal. these defenses never work in my jurisdiction.

consult your local attorney i dont know if these defenses work in canada. laws could be different. but in my jurisdiction these defenses dont work.
