generally, no. when you say "settled" I assume the case was litigated and there was a settlement agreement signed by the parties; in which case you cannot change you're mind and try again in arbitration. usually, what occurs is the reverse situation. the claim goes to arbitration and there is a decision; and the unhappy party goes into court and essentially asks the judge to set aside the arbitration award.

bizarre. that makes no sense to me. there must be two separate claims going on. this is in the context of a car accident? I don't do much personal injury, but just from a general legal perspective, once the case is settled, that's it. its over. especially if they paid you.

if you ever find out whats going on, let me know; because that is just strange. i'd say the other guy's atty & insurance company were more incompetent if they paid out and now they're trying to get it back in arbitration. that's laughable. I think there's something more to this, that you aren't telling us. like maybe they paid out on a property damage claim, but you're going to arbitration for losing a portion of your hawg, or something similar.

But of course, those are just a couple variables of many to be considered.

They're stylistically different wrestlers who present different problems, but I think it's fair to say that Koscheck has proven the harder guy to take down and hold down.

Kinda changes the dynamic of things to go getting all quasi mma math with a Kos-Alves-Fitch wrestling correlation ..... But anyways, Koscheck took St. Pierre down. I'm not using MMA math, my point was that it's an over-simplification to say that Koscheck is a better offensive and defensive wrestler than Fitch. Styles make fights, even in wrestling. If Koscheck is flat-out better at offensive wrestling, he wouldn't be 0/5 for takedowns against Alves, while Fitch was 9/11. Alves is an awful stylistic matchup for Koscheck, and Fitch is an awful stylistic matchup for Alves. Alves is great at defending takedowns from everyone this side of GSP, but if you stick to him and grind him out, he has no answer for it. Story of his career. Hughes was 1-7 against Alves on takedowns. He's really good at stopping shots.
