    Gamebookers adds questionable policy
    A few weeks back I worked on an interesting dispute from Gamebookers. Summary here.

    Long story short: player limits slashed, bet wrongly graded, player sends obscenity laced email tirades, has account closed & funds seized with no elaboration other than "managements decision".

    The decision was eventually reversed.

    Today the player points out what he is calling a change to Gamebookers T&C. We have attempted to verify claim with cached pages and our rules monitor, but were unable to do so. Nevertheless, a dubious clause.


    12. THIRD PARTY CONTENT
    12.1. Abusive or offensive language will not be tolerated on Our chat boards, or otherwise by You on the Platforms or with Group staff. In addition, You are not entitled to make untrue and/or malicious and/or damaging comments with regard to the Group's operation in any media or forum."

    No one should seize any funds of another because they use offensive language IMO.

      LOL. I wonder how long before some muppet commission gets a dispute and says "Yes, Gamebookers cleary misgraded your bet and refused to fix it, but since you posted publicly that Gamebookers misgraded a wager, and that could hurt their reputation, not only will your bet not be fixed, but your entire balance will be forfeited. Have a nice day."

        Agreed General. I have no problem with them taking measures when their staff is faced with abusive language. But closing an account and seizing the funds is obviously going way too far and is just an excuse for outright theft.

          Each book give themselves the right to do whatever they want. Even pinnacle.

          I don´t know why, but I´m playing with gamebookers/partybets without any problems for more than 4 years.

          (one of the very few books I never have any problems with)

            I wouldn't worry, it's just a poor attempt to convey that defamation of Gamebookers is unacceptable. This needn't be in the terms anyway since defamation is covered by external law and having players agree to terms doesn't suddenly give Gamebookers more legal standing than they had without stating this.

            Making a false claim is completely unacceptable and in many jurisdictions people and companies can take action against those making the false claim.

            I know of no juridiction where a company could take action against someone making a completely factual and true comment even if it may be damaging to them.

            Basically, they should just remove the bolded text because it makes no sense really.

              If you say something "negative" or "derogatory" or "malicious" or "damaging" to them in a public forum, and what you say is true, you cannot be sued for libel or slander. It amounts to censorship, pure and simple.

              The word "untrue" in the bolded policy is redundant, because you're already not allowed to say anything untrue about them.

              If I had any money there, I'd pull it out immediately, not because this new policy necessarily is indicative of any financial trouble, but because I would not be willing to adhere to the bolded part of the ToS, which for all intents and purposes, is a binding legal contract. I will not be censored.
