    South Texas DPS Highway Patrol sergeant resigns before being arrested on child sex charges

    KLEBERG COUNTY, Texas — Texas Rangers arrested a Department of Public Safety Highway Patrol sergeant Tuesday on charges of indecency with a child, a press release from the DPS said.

    Andrew Smith, 33, who was about to be suspended from his position, resigned early Tuesday before being arrested, DPS officials said.

    Officials said the charge stems from an investigation that was initiated after a juvenile made an outcry on Jan. 8 regarding the alleged off-duty assault.

    The subsequent investigation by the Kleberg County Sheriff’s Office, Texas Rangers, and Kleberg County District Attorney’s Office resulted in an arrest warrant being issued for Smith.

    Smith was booked into the Kleberg County Jail on the charge of Indecency with a Child – Sexual Contact, a second-degree felony. The investigation remains ongoing.

    Smith, 33, started with DPS in 2010 and was a Highway Patrol Sergeant in Falfurrias.

    Smith is out of jail after posting a $40,000 bond.

    Cop Banned From All Taxpayer Jobs After Video Showed Him Mace Innocent Teen for Fun

    Woodlynne, NJ — As TFTP reported last June, several teenagers were hanging out with friends, on their own property, when officers with the Woodlynne police department walked up to them. Without provocation, Woodlynne police officer Ryan Dubiel randomly pulled out his pepper spray and blasted one of the teens in the face with the spray before spraying several others. This move led to charges against this officer with a severely tarnished past and this month, we have learned that, as part of his sentence, he will no longer be able to work in a taxpayer funded position ever again — a move, we’d like to see more often.

    As the Courier Post reported Thursday, Dubiel, 32, was sentenced to one year of probation under terms of a plea agreement. As part of his plea deal, he also had to forfeit his law enforcement license but then prosecutors took it one step further — barring him from holding “any public office (in) New Jersey, including employment as a police officer,” the prosecutor’s office said in a statement.

    As we reported in June, the boys would be accused of trespassing by the officers — in spite of not trespassing at all. When they chose to assert their right to remain silent when the officers asked them questions, officer Dubiel snapped. When another teen didn’t immediately hop up and start doing everything the officer asked, he pulled out his pepper spray and doused a teen directly in the face, hitting another 20-year-old behind him

    “We saw it over the internet and stuff, but we never thought it would happen to us,” said 16-year old James Horn, who witnessed his friend get sprayed in the face.

    As the video shows, the 15-year-old boy is sitting on the stoop is trying to text his brother, who is his legal guardian. Dubiel tells him to put his hands behind his back and before he can comply, Dubiel unleashes the chemical weapon into the teen’s face. He then sprays all the other folks in the group on the porch.

    As ABC 6 reported, a 911 call released by the Camden County Prosecutor recounts a property owner complaining about a group of teens loitering and smoking marijuana.

    There was no marijuana, and the only thing found on the young men was cigarettes. Also, they weren’t trespassing.

    “My friend said he was going to call his brother and the officer said no. But his brother is his guardian so he said he was going to call him anyway. And then the officer started pepper spraying everybody on the porch,” said Horn.

    The officer’s use of the irritant “was not consistent with the (state’s) use-of-force policy, the prosecutor’s office said.

    “Our Special Prosecutions Unit received the Internal Affairs complaint against Dubiel on June 5 and immediately began collecting all of the evidence to conduct a thorough and impartial review of the complaint,” said Camden County prosecutor Jill Mayer in a statement. “After careful review, it was clear Dubiel’s actions are not consistent with the State of New Jersey use-of-force policy.”

    A the time the charges were released, prosecutors told local media that in his short career, the 31-year-old has worked for nine police departments.

    Nine departments!
    This is the problem prosecutors set out to remedy with Dubiel’s sentence. This man should have never been hired with the Woodlynne police department, nor the 6 or 7 other departments before that, yet he was. He has faced misconduct allegations before but like so many other officers, was likely allowed to resign before facing any consequences. Apparently, he’s done this at least 8 times.

    New Jersey’s attorney general said this is “a strong example of why we need a statewide licensing program for police officers.”

    “I question once again, our mayor, why would you put an officer, or allow an officer to be on the street, knowing he has two strikes against him against the general public?” said Woodlynne Councilman Clyde Cook.

    We agree and so would most people. However, nearly every single cop who gets caught unjustly killing or beating someone has had a similar past. This happens so much that there is a term for them. They are called gypsy cops. We are pleased to see that at least some action is being taken to stop this.

    High Level Cop Exposes Illegal Quota — Cops Told to Make Arrests Even if There’s No Crime

    Chicago, IL — Most people reading this article know what it is like to have the blue and red lights pop up in your rear view mirror. The last thing going through your mind at this point is the feeling of ‘being protected.’ This feeling comes from the fact that the overwhelming majority of the time a driver sees police lights in their mirror is because they have been targeted for revenue collection—often the result of a quota system—and they are about to be given a ticket, or worse.

    Police, we are told, are here to keep us safe and protect us from the bad guys. However, public safety all too often takes a back seat to revenue collection. Time and time again, the Free Thought Project has exposed quota schemes in which officers were punished for not writing enough tickets or making enough arrests.

    The most recent ticket writing and arrest scheme to be exposed comes out of Chicago, Illinois. The Chicago police department is one of the most notoriously corrupt departments in the country which is why it should come as no surprise the cop who exposed the illegal quota system was retaliated against.

    Chicago Police lieutenant Franklin Paz, Jr., 48, has since filed a lawsuit against the department after he was demoted and reassigned to an entry-level position for exposing the department’s illegal arrest quota. Paz was in charge of a “platoon” of cops in a special unit called the Community Safety Team. As the lawsuit illustrates, however, the team was not at all concerned with safety, nor did they care about community.

    The quota system, according to the lawsuit, was run by Deputy Chief Michael Barz who urged Paz and other lieutenants to increase the number of arrests, traffic stops, and tickets — regardless of actual criminal activity. In other words, cops were told to act like mafia goons and constantly shake down and harass citizens within the community.

    “The use of numbers and statistics, particularly traffic stops, became the primary basis that Barz used to evaluate the work that the officers under his command were doing,” the lawsuit said.

    The lawsuit also said Barz “expected” officers assigned to the new team to “generate specific amounts of police activity per shift they worked.” According to CBS 2, there are more than 1,000 officers assigned to the CST, which means tens of thousands of citizens were harassed by them on a daily basis.

    The CST, according to Paz was made up of former SWAT team members, gang unit officers, gun and saturation teams. These cops with tactical training in kicking in doors and holding people at gunpoint were then unleashed on the community and forced to stop entirely innocent people to keep their numbers up.

    Barz “demanded certain numbers relating to police activity, regardless of the criminal or traffic activity justifying police intervention,” according to the lawsuit.

    “In other words,” the lawsuit said, “regardless of the criminal activity occurring that day, his officers were required to make the same number of stops.”

    As CBS 2 points out, because police quotas are illegal in Illinois, Paz believed Barz was pressuring officers to “engage in illegal activity” that could lead to the profiling of residents. State statute says a police agency cannot require an officer issue a specific number of citations within a certain period of time.

    “By demanding a certain number of stops without regard to the criminal activity justifying those stops, Barz was effectively requiring officers to engage in unlawful profiling, seizures of people that were not justified by probable cause, and violations of the civil rights of persons they encountered,” the lawsuit said.

    When Paz attempted to confront Barz about the illegal policing, according to the lawsuit, Barz said, “F*** community policing, I need activity”, and on another occasion, threatened to “blow up the entire platoon” and “dump” everyone from the unit if they did not comply.

    On top of harassing, arresting, and ticketing innocent residents of Chicago, the CST team was killing them too. In August, a massive protest broke out after cops shot a man in Englewood. Because CST cops aren’t required to wear body cameras, it was the cops’ word against the citizens who witnessed it, and they disagreed.

    Showing how the system is set up to get rid of the good cops and reward the bad ones, despite running an illegal quota scam and harassing innocent people, Barz was promoted to Deputy Chief in September.

    “Instead of focusing on the community safety, the new unit instead has become dedicated to making pointless traffic stops, often with no basis, so that Barz and the CPD can brag about their ‘activity,’” said a statement from Torreya Hamilton and Thomas Needham, Paz’s attorneys.

    “The police strategy is against Illinois law, which explicitly prohibits police quotas,” the attorneys said. “It is also unproductive and pointless, resulting in thousands of annoyed and embarrassed Chicago motorists who are being stopped for no reason, thereby having their rights violated.”

    SAPD officer slapped with new bribery charge for giving info to domestic violence suspect, officials say

    Officer Erik Rodriguez also charged with felony misuse of official information

    SAN ANTONIO – A San Antonio police officer has been arrested again in connection with a case in which officials said he accepted money in exchange for providing information to a suspect in a domestic violence case.

    Erik Rodriguez, a 14-year veteran of SAPD, was arrested and charged with bribery on Wednesday. He was also arrested last week for misuse of official information in connection with the case.

    A detective became aware of the allegations against Rodriguez after the victim in a domestic violence case said she believed her abuser had a friend providing him information, the release states.

    The detective later discovered that not only had Rodriguez provided case information to the suspect, but had been paid by the suspect to do so.

    SAPD Chief William McManus released the following statement last week:

    “Preventing family violence and providing services to victims has been and remains a priority for the San Antonio Police Department. I am bitterly disappointed and frustrated that an SAPD Officer would violate his oath of office and the public trust by placing a survivor in jeopardy. The quick response of the SAPD Detective assigned to this case reinforces that there will be swift and serious consequences for any type of misconduct. The investigation of the officer and the abuser will continue, and additional charges may be filed.”

    Rodriguez is the first SAPD officer arrested this year.

    On12/5/20 I was unlawfully arrested by Officer T.E. Robinson and Detective Quintana of the Jacksonville Sheriff’s Office (JSO) under the direction of a Jacksonville Transportation Authority (JTA) Supervisor. The arrest took place at JTA’s new Jacksonville Regional Transportation Center located in downtown Jacksonville, Florida. My plan was to use public transportation to travel to different locations throughout Jacksonville where I would advocate for the homeless on the public sidewalk. The JTA Supervisor and the two JSO Officers incorrectly assumed that I was panhandling because of my GBTH (God Bless The Homeless) sign.

    Tone Deaf Dept Owned on Twitter for Bragging About ‘Ghost’ Car to Hide While Extorting Citizens

    Durham, NC — The Durham Sheriff took to Twitter recently to brag about the department’s new “ghost” cars and how they are intentionally hard to see because of the low profile graphics and hidden lights. The reason this car will be hard to see, according to the sheriff, is so they can better catch citizens who dare to break traffic laws. Because many of these laws involve extorting citizens for crimes which have no victim, the sheriff has been put on blast by the Twitter community.

    The department bragged about literally hiding from the citizens they claim to protect and serve. What does it say about a public servants who don’t want to be seen in order to catch people breaking the law. If they truly cared about keeping the citizens safe, wouldn’t they make the most visible cars possible.

    When someone sees a police cruiser, they tend to drive safe, not speed, buckle up and obey the law. Hiding from the public so they break these laws shows that it is not about getting people to stop breaking the laws, it’s about letting them break the law so police can then extort them.

    In the land of the free, millions of traffic tickets are issued each year in which people are issued a threat of extortion for any number of arbitrary and victimless infractions. In fact an average of 125,000 people in the U.S. receives a traffic citation every day — more than one every single second. The average extortion fee will cost you around $150, but in some states a driver can be fined up to $2000 or more depending on the offense and the state laws. Given that many of these fines are for infractions which have no victim, it is literal highway robbery.

    A traffic ticket can ruin anyone’s day, and in some instances end their life. Given the sheer number of traffic citations issued every day, one would think that this may have some effect on safety but it does not. Traffic violations remain constant, regardless of police issuing fines. The fact is that cops need you to break traffic laws as it is a means of supporting themselves.

    The total number of speeding tickets paid each year is $6,232,000,000 which breaks down to around $300,000 generated per police officer for speeding alone. Tack on seat belt violations, license plate lights, window tint, rolling stop signs, and expired state-mandated documents and that number sky rockets.

    It is literally highway robbery conducted on behalf of the ones who claim to keep us “safe” and it has no effect on safety at all, as shown by the number of traffic fatalities every year.

    In the meantime, a study published in the Public School Forum of North Carolina shows that schools — which help to educate children, not extort them — are inveterately underfunded in the Raleigh/Durham area.

    “Year after year, our poorest counties fall further behind our wealthier ones in terms of resources available to their local schools,” Keith Poston, president and executive director of the Public School Forum of NC said in a statement. “These funding disparities have a real impact on educational opportunity for students, particularly in in terms of the ability of lower wealth counties to fund local supplemental pay to attract and retain the teachers they need to serve students.”

    While students attend crumbling schools, cops are getting shiny new vehicles that are hard to spot so they can entrap struggling citizens and extort them for failing to renew their license, failing to update their registration, or any number of various predatory bureaucratic violations.

    So, when the cops took to bragging about this act, citizens responded in anger — some of them elegantly.

    “School lunches: $5 Road maintenance: $10 Public housing: $15 Blinky lights on shiny cop car: $40,000 Someone who is good at economy please help me budget, my community is dying.”

    “The irony of calling this #communitypolicing is truly unfathomably painful. Nothing says “out of touch with community” quite like a suped up Dodge Charger with hidden police graphics in a town with a per capita income of 34k.”

    “This goes to show the first thought of american police is “how can I catch my prey” and not “how can I help my community. In what world does this help ANYONE but yourselves????”

    “hello 911? yeah i’ve got a problem, the fascists in the sheriff’s department took my tax money to buy themselves toys and are now making veiled threats online”

    Instead of realizing the tone deaf nature of their post and responding in kind, the sheriff’s department went on the defensive and said that bragging about a police car that is hard to spot so they can catch you in a traffic violation, was taken out of context.

    "We never expected such a large response to this video. Its intent was to be a lighthearted look at a tool our traffic unit uses to keep roads safe but it was taken out of context for some. DCSO values your thoughtful feedback &will continue to be engaged w/the community it serves."

    Naturally there were the apologists in the comments as well, saying, “If you don’t break the law, you have nothing to worry about.”

    However, that statement couldn’t be further from the truth.

    Former NSA official William Binney sums this myth up quite accurately, “The problem is, if they think they’re not doing anything that’s wrong, they don’t get to define that. The central government does.”

    Attorney Harvey Silverglate argues that the average American commits three felonies a day without even knowing it.

    While most everyone in America commits the same infractions designed for revenue collection, most of the people targeted by police for these crimes are the poor, minorities, and the mentally ill.

    As the death of Mike Brown in Ferguson exposed, African-Americans accounted for 86 percent of traffic stops while making up only 63 percent of Ferguson’s population.

    For those too poor to pay their tickets, routine traffic stops end up in repeated imprisonment due to mounting fines. People get trapped in the system and unless they can come up with the thousands of dollars to get out from under these fines, they will likely end up back in that system — over and over again.

    It’s a debtor’s prison and it’s horrendous.

    Revenue collection, persecution of the poor, and these debtor’s prisons take place in every county, in every city, across every state. However, this institutionalized cruelty is little more than a day’s work for the millions of bureaucrats involved in the racket.

    A federal judge on Friday revoked bond for a suspended Chicago police officer charged in a sports gambling scheme after prosecutors revealed the officer’s girlfriend accused him of trying to kill her during an incident at a hotel last week.

    In ordering Nicholas Stella to be jailed, U.S. District Judge Virginia Kendall said she was concerned about Stella’s previous domestic violence
    arrests, including one from 2019 when he allegedly punched the same woman in the mouth and threatened to get his gun and shoot her if she left him.

    Today, the Office of Professional Standards within the Calhoun County Sheriff's Department concluded its investigation into the January 2, 2021 incident involving sheriff's deputies in the City of Springfield, Mich. The deputy who chose to arrest Mr. Marshall has been terminated.

    We hold ourselves to high standards of professionalism to the communities we protect. When we are right, we are right. When we are wrong, we admit we are wrong.

    On January 2, we were wrong. Transparency and honesty to our community is the foundation to all of our success. The conduct and actions of this case, in which Mr. Marshall was collecting signatures, does not represent our commitment to our community. The actions that Mr. Marshall took that day of circulating a petition are protected by our constitution.

    While some ordinances in communities, even within Calhoun County, prohibit vendors from selling items without a permit, no law—local, state or federal—prohibited Mr. Marshall from exercising his constitutional rights on January 2.

    Sheriff Steve Hinkley and Undersheriff Tim Hurtt had a productive conversation with Mr. Marshall and his attorney two weeks ago, and the criminal charges in the case were dismissed.

    A pig has his feelings hurt after a man calls him an "idiot." The pig was then too much of a coward to confront the man himself so he sends his pig partner to seek out an apology. The man refuses to apologize and the pig threatens to arrest and cage the man if he called his partner that again. LOL I'd like to know these feelings police officers' names and vaj numbers.

    “At no point did they tell him to put his hands behind his back, to stand still, they never tried to deescalate the situation. They just immediately went for full-blown physical force,” Long said.

    The guard still had his taser drawn when a second security guard showed up. At that point, the first guard holstered his taser and Long and her son went back towards her car.

    Long wanted to move her car but wanted the guards to help her son get into the ER to receive treatment. Instead, the video shows, when her back was turned, the second security guard grabbed him by the neck from behind and jumped on top of him, tackling him to the ground.

    Once the boy was on the ground, video shows pools of blood dripping from his mouth.

    He stayed on the ground for more than five minutes with both guards on top of him. The video shows the guards stunned the boy with a taser twice.

    “I was in shock! I didn’t know what to do,” Long recalled. “I was just kind of helpless to do much of anything.”

    The video shows her standing near her son as he lay on concrete driveway in handcuffs, with both guards on top of him and blood dripping from his mouth.

    That changed when four deputies with the Lincoln County Sheriff’s Office showed up.

    The deputies told the guards to get off the boy and he was sat up.

    The boy, who had a mouth full of blood, spit as he was sat up. In response to the boy spitting blood, the video shows a deputy punching the boy in the face twice.

    That deputy - who was later identified as Justin Polson - was so irate, the video shows, he ran over to Long and began yelling at her before a second deputy pulled him away and ultimately pulled him to the ground to control him.

    Lincoln County Sheriff Bill Beam said Polson did nothing wrong in punching a 16-year-old boy whose hands were cuffed behind his back.

    “Deputy Polson had a reaction to a felonious assault,” Beam said. “Spitting in a law enforcement officer’s face - spitting blood in a law enforcement officer’s face - is a felonious assault and he had a right to stop that assault from occurring.”

    In fact, Beam denied Polson punched the boy in the face at all.

    “Your deputy punched a 16-year-old with his hands handcuffed behind his back, twice. Is that an appropriate use of force?” a WBTV reporter asked Beam.

    “All I saw was once and he was pushing him back away,” Beam responded.

    Beam said Polson was disciplined for his behavior towards Long but his personnel record does not reflect a suspension, demotion or transfer.

    WATCH: Mom Brings Child to Hospital for Mental Help & He’s Handcuffed, Beaten, & Tasered — Lawsuit

    Lincolnton, NC — A Lincolnton mother found out the hard way what TFTP has consistently reported over the years. Those who are suffering from mental health issues are uniquely susceptible to police brutality and an escalation of the use of force. Sadly, however, it was her mentally ill son who served as the example and she has no recourse because the officers “investigated themselves” and found no wrongdoing.

    In December 2019, Jessica Long took her 16-year-old son to Atrium Health’s emergency room for mental health treatment, the kind he’d received in the past. However, instead of mental health treatment, the teen got a beat down, courtesy of Atrium security guards and a Lincolnton police officer who arrived later — only to punch the already-bloodied, and handcuffed teen in the face.

    Now, because the officers were not held accountable, Long is forced to seek justice through a civil lawsuit.

    Long’s attorney, Brad Smith of Charlotte, told the Charlotte Observer the video clearly shows that the Gaston County woman and her son came to the hospital “in crisis and in desperate need of medical care.”

    “What they received instead from these defendants was a horrific violation of their most basic and fundamental rights,” Smith said in an email, adding that the officers’ violent methods undermine community trust.

    “Do we live in a society where people … should be afraid to come to the hospital or call the law out of fear of being assaulted and arrested?”

    According to the lawsuit, after they beat the mentally ill child, the officers libeled and slandered the family by making false statements about the confrontation and the teenager to justify their actions, while also sharing the teen’s private medical records with unauthorized individuals.

    As we reported at the time, Long’s son was reportedly angry and didn’t want to be at the hospital. It was just after midnight on December 8, 2019, when the family arrived. Long asked for security to assist her with her son. But instead of kindness and compassion, less than one minute after an Atrium Health security guard arrived, Long’s son was violently thrown to the ground and threatened with a taser.

    “At no point did they tell him to put his hands behind his back, to stand still, they never tried to deescalate the situation. They just immediately went for full-blown physical force,” Long said.

    The security guard grabbed the teen by the head. The frail teenager reacted to being assaulted by throwing a few powerless punches in the direction of the guard who apparently weighs several hundred pounds. The guard then threw him off the sidewalk and into the grass. Immediately, the guard went for his taser and threatened to taser the kid. We’re sure that electrocution was not the kind of shock treatment the family was likely hoping to receive from the hospital.

    After a second security guard arrived, and while the mother’s back was turned, he grabbed the kid by the neck, leg tripped him, and threw him to the ground, causing the kid to bleed profusely from his mouth. Both guards then got on top of him, tasered him twice, and held him there until police arrived.

    Once Lincoln County deputies arrived, things did not get any better for the boy. Even though he was sitting down on the curb and in handcuffs, he allegedly started spitting bloody spit at the cops. One of the cops lost all control and punched the handcuffed teen in the face twice before being restrained by a fellow cop who actually had to take him to the ground to restrain his fellow boy in blue. The cop who hit the handcuffed teen in the face was later identified as Justin Polson.

    Long recalls the helpless feeling of being able to do nothing to help her son prevail against heavily armed cops and security guards.

    “I was in shock! I didn’t know what to do…I was just kind of helpless to do much of anything,” she said.

    Sheriff Bill Beam completely denied Deputy Polson hit a handcuffed teen in the face after being spat upon. Beam was asked by a WBTV reporter if that action was an “appropriate use of force.” Beam adamantly denied the fact his deputy punched Long’s son in the face.

    Polson has since filed a counter suit against long, in which he accuses the teen of felonious assault for the alleged bloody spit.

    Like Sheriff Beam, Atrium hospital officials are also standing by their security guards. Maureen Swick claims the actions of her officers were “safe and appropriate” but added they are “truly sorry for what this young man went through.”

    In our opinion here at TFTP, it all started because a massive hospital security officer did not know how to control a teenager without laying hands on him. Had he been a teacher he would immediately been fired. But given the fact he has a badge and a taser, he is able to get away with unnecessarily escalating use of force against a teen who needed a hospital bed instead of being placed behind bars for 8 days.
