Hypothetical question here. Sometimes when I drink I will sleepwalk. I was living with my girlfriend one time and began sleepwalking drunk. I got the keys for my ute and went outside. She followed and asked me what I was doing. I told her I was driving to Adelaide. She convinced me not to go.
So, if I'm sleeping and driving while drunk. Could I still be charged with drunk driving?Comment -

Good post OP! Hope you guys all have a good new years eve, but **** it, stay off the road if your drinking. There's no reason ESPECIALLY on that night to even think about getting behind the wheel. Sleep in your car, bang a whore, sleep in a garage, on a couch, on the floor, in a pool, wherever.

I plan to drink, i bet alot of us are, but def don't be that loser who drinks more then they can handle and insist on driving. lets build up the economy with our Beer sales and our taxi fares, not our hospital bills and funeral arrangements. I know a state trooper locally who told me a story about a wreck years ago in which an automobiles entire engine ended up on top of another vehicle, killing a family which had little kids in the back seat.
Remarkably the driver at fault is fine, gets out of his vehicle, and makes his way to this officer throwing his hands up in the air then pointing at the car with the deceased family cursing them.
The guy was so drunk he had no inkling half of his vehicle was lying on top of them and they lay dead underneath.
The trooper said he himself broke out in tears and that it took everything within him to keep from laying the guy out.
