In general, they don't have a case unless it's against the CBA (?). A crazy bootstrap way would make it unconstitutional on 1st Amendment ground by using Trump. 1) Show that NFL is a monopoly and use USFL "victory" in court to prove it. 2) Trump's actions had made NFL a "quasi- government" agent which now Constitution laws are applicable. Owners could argue that he has the right to fire a player for insubordination.
The employer (owner) gives the employee (player) a directive "please stand for the anthem, I ask because it may come across as disrespectful to some" and the player says "no, I can kneel if I want to" that is insubordination and it can lead to termination.

If my boss gives me a rational directive and I refuse, watch how fast I get an insubordination write up (or worse)
