Odor is a punk! If he really knew how to play second base he would have jumped and threw. The slide was low and clean, all he had to do is jump over Bautista. I guess you can't try to break up doubleplays without these punks wanting to fight. Only a moron would compare that slide to Utly's.

Well, first off, it's battery, not assault. There is no contact to another person in the legal definition of assault. There are elements that must be met, but it's basically the threat or imminent unwanted contact to another person. Battery is the harmful or offensive contact to another person.

As far as a deadly weapon, there was none. Except for professional boxers, MMA fighters, and delusional poster acoochy, a person's hands or legs are not considered deadly weapons.

As far as an athlete seeking legal recourse for an act or injuries that occur from playing a sport, you run into a consent argument. Both players are consenting to play the sport. Is a fight that of the ordinary in baseball? Usually, the "fight" is benches clear, some pushing and shoving, but not much happening. However, I'd argue that a punch being thrown during a baseball scrum is not something so out of the ordinary that it falls outside of the scope of consent for being out on the field.

As a fan, you have zero expectation of having an altercation with an athlete. Therefore, when something like that soccer player drop kicking a fan or the Malace at the Palace happen, you never buy a ticket to watch a sporting event and expect an athlete to batter you. Not to mention, it looks terrible for the organization. Therefore, suspensions will be some of the highest you will ever see and legal action will be taken.

Let's say Odor went to the dugout and grabbed a bat and struck Bautista with it causing injury, or threw dirt into his eyes, blinding him or causing permanent injury, then you have a scenario that is outside of the expected play of the sport. Or, see what Bertuzzi did to the Avalanche player (hitting him in the head by swinging his stick and then cross checking him in the back of the neck, breaking his neck). A situation like that would not be consented to and it is far outside of the game.
