You're wrong in saying he can't get in trouble for private conversation, the NBA constitution applicable to owners gives the league the right to level a fine, Sterling signed a contract agreeing to said document.

However, the league has no power to strip an owner of a club, the owners never gave the league such a right.

The biggest problem Don has is not only didn't they have to actually strip him of the team because of Shelly's sale to Steve Ballmer but at 2 billion sales price it will be hard to prove any financial damages.
