                  No. Implied consent when you buy the ticket. Says on the ticket, is announced at the beginning of the game, signs posted in the seats. Plus, ushers won't even let you walk down to your seat in the middle of an at bat. All that + common sense.

                    Believe it or not the Supreme Court in New Mexico ruled against the implied consent rule resulting in the Albuquerque Isotopes paying a fat $$ settlement to a fan who was hit in outfield seats . Believe NM is the only state with this position.

                          Reminds of the old Randy Johnson days in Seattle, my seats were just past the dugout on the first base side and every team would put up a righty line-up, always behind the fast ball fouling off pitches right at us, you had to watch every pitch.
