However, last month, a Washington District Court Judge deemed two of High 5 Games’ mobile apps illegal. Judge Tiffany M. Cartwright found that both High 5 Casino and High 5 Vegas violated the state’s Consumer Protection Act (CPA) and Recovery of Money Lost at Gambling Act, since the coins used on the site are items of value under Washington law.
High 5 is now responsible for compensating a group of customers for any losses they suffered on the platforms. The exact amount of compensation will be decided by a jury at a later date.
High 5 Games controversy in Washington
In June, two mobile game apps offering High 5 Games products were ruled illegal in Washington State. The verdict came after Judge Cartwright found High 5 Vegas and High 5 Casino to offer online gambling, which is currently illegal in the state.
High 5 contended that it operates virtual coins and, therefore, constitutes a “social casino” that doesn’t offer real-money gambling. However, the judge determined that online gambling constitutes any activity that requires users to purchase a stake in a game of chance, with a prize offered on a certain outcome.
The ruling came six years after Rick Larsen, a High 5 Games player, sued the company, claiming that the app promoted illegal gambling because it required players to purchase additional game tokens for real money.
The company’s response was that players aren’t required to purchase additional coins and can access its games for free, hence not requiring players to spend real money to participate.
