    if the lawyer is any good at all they should at least be able to get it knocked down to a wreckless. and you should never blow. its so easy to fail that test its crazy. and if you say youve had any the cops will **** you on the eye stag test. the car cameras will never pick up an eye twitching so its your word against theirs and we know which will hold up. but on first offense you should be fine with a decent lawyer. i blew a .174 and still got mine knocked down. ( got the blow test thrown out ) and you can get a work permit in most cases with a lawyer.

    just speaking from personal experience.

    Ive had 4 duis in last 35 years---had them spread out pretty good---Have not had one in last 15 years---I drink and drive almost every day---drive only on roads you are familar with, obey all traffic laws, make sure all equipment is working--29 mph over after a few drinks is really dumb---so was my last dui---expired tag---Good Luck.

    in wisconsin it is immediate 1 year revocation of your license for refusal to take breathalyzer.

    Bullshit, laws vary state to state. Your states laws might be soft but dude says he lives in Illinois. In Illinois there is a consent law that requires all drivers to submit to alcohol testing if pulled over for suspicion of DUI. If he is found guilty, which he will be unless he gets a damn good lawyer, in Illinois even a first offense carries a penalty of up to 360 days in jail plus fines, license suspension , and other penalties depending on who is the judge. Some judges will throw the book at you and some won't.

    Not true...I have friends that were convicted without blowing...the states attorney and po po used the smell on his breath, the way he walked and some of the answers to questions to find him guilty....

    I think smoke is tryin to be funny. Number 1 rule when caught for a crime is to never admit guilt. Even if your on HD videotape, you still deny it. Blowing and failing is admitting guilt. Refuse the test, then make up some bullshit as to the reason why you refused it.

    i agree number one rule is to never say anything to a cop except your name/show id. UNLESS IT IS DRUNK DRIVING WITH IMPLIED CONSENT LAWS.

    in wisconsin from what i hear they are actually tougher on guys that don't blow than the guys that blow .15 (limit here is .08)

    for every other crime i wholeheartedly agree, the prisons are full of guys that would never be there except for the fact they admitted to something. almost impossible to prove fraud for a bounced check, for example, without an admission of guilt.

    This is very true and happens a lot. But the point is, by refusing, you have wiggle room. At anytime before your friend was convicted, he could have pled out to a lesser charge. No county in the state wants to go thru a trial if it can be avoided. If you fail the breathalyzer, you have no wiggle room and are pretty much on the mercy of the court. A good criminal lawyer will tell you straight up, that you shouldn't blow if you been drinking.

    I think it would have been smarter to ask for the blood test. If you only have 3/4 by the time they got you to the station then to the hospital you would've been sitting well below .08. Regardless I'm not an inconsiderate bastard who drives drunk and have absolutely no sympathy for you.

    Maybe your right about the state or county. Here in NYC they're quick to give good deals and second chances, bcause so backlogged. If they have you dead to rights, they're less inclined to give you a sweet deal.

    I dont know if this will make you feel better. But I have a buddy who has 5 DUI's and 10 driving on revoked and never seen any jail time. Cost him about a 100k though and he's been sober now 5 years. He has a great job though so he could afford the cash.
