    corny field sobriety schtick aside, -900 this cop beat his dick like it owed him money within ten minutes of making it home after his shift just thinkin about what he'd liked to have done to her at the scene.....

    yes, but as I often tell clients, if you know you've been drinking and are going to fail the tests, once you do fail, you're looking at the same exact suspension if not longer

    in other words, fuk the police, do NOT do field sobriety tests, do not give blood or blow voluntarily if you know you're going to fail.... all you're doing is giving them the evidence they need to convict you.

    be polite, politely decline the field sobriety tests and any field breathalizer, decline all tests back at the station. if they threaten you with arrest for not doing the tests, politely ask for your lawyer and stay calm, if he says turn around, say "this is ridiculous, I want' my lawyer", then do what he says about getting into his car.

    I've had clients say the cops, if they think the case may be weak (ie, you don't appear smashed), they'll let you go rather than risk a "no evidence" case against someone who looks relatively sober on their dash cam

    Automatic maximum range penalty for refusal down here.

    Not sure what American judges are like but you want to be smart with a cop down here and tell them the law or refuse orders, the judge will give you a big cheesy grin as they tell you they dont give a shit what you think and give you the max they can.

    But I got a boat license recently and found out if they dui me on the water I lose my car license too. Which I thought was stupid and sucks.

    No one do what this post says to do EVER! What will happen with that attitude is hand cuffs and unnecessary ankle shackles (for being an @ss). The cuffs and shackles will be placed on tightly. You will be transported to jail and released to the detention officers and the officer will request you get "special" treatment. You have no right to a phone call so they can hold you in a holding cell for 20 hours. The officer will request a blood warrant and fill out a PC affidavit. The judge will grant that warrant. Failure to comply with the warrant will result in additional charges. If you refuse, the officer will be within his authority to take a blood sample by force at the hospital. If the test comes back positive, you will be facing multiple serious charges. Don't listen to this guy. Just comply and the officer and detention officers will be easy on you. You will see the judge and show remorse and you'll be out on bond in a few hours.

    if you're white, you can follow the refusal advice.... do drop the "f u's" and "jack shits" or they may pretend youre black.....

I'll do anything you want... please please please don't arrest me. The state trooper got his hog sucked. Let her go....

    Well... the dumb a$$ girl told all of her friends. All it took was a phone call to Tennessee State Police Department... dude lost his job. No one knew about it for about 6 months. Women are so dumb.

    Unless you think that you will perform well on the test and only if you are certain there is a camera. Cop will likely lie/embellish in report and the video can be used to your benefit at trial or in plea negotiations. Prosecutor/Judge is going to draw negative inference from your refusal to cooperate.

    In NJ, refusal is same penalty as failing. And, if you refuse you lose the opportunity to get the BAC tossed because cop f'd up Alcotest which happens all of the time. I'd take the test. Only benefit is that a refusal does not count as a "first" if you get a second. So, if you are so f'd up you are 100% convinced you will one day get hit with a 2nd, then maybe refusal way to go. Inverse cannot be used to your benefit. Refusal on 2/3/4th etc. is still considered your 2/3/4.

    Your best bet is probably to have your own dash cam because you will catch virtual every LEO lying, misremembering facts or just being complete pigs which will hurt their credibility. Without any direct evidence to the contrary, LEO will have an "inducia of credibility" while testifying in Court. It's a load of b.s.

    The prosecutors have a history of doing whatever the he!! they wish anyway. The Judge IS NOT going to draw a negative inference. Your "refusal" to take a field sobriety test IS YOUR CONSTITUTIONAL RIGHT. Something the police are DILIGENTLY TRAINED IN to coerce the citizens into surrendering those rights. Police have many ways of doing this by their speech. "You don't mind if I have a look around the inside of your vehicle?" "I need you to step over here so that I can give you a field sobriety test" "You need to stand on one leg for me and recite the alphabet backwards"... These are all examples of leading questions designed to trick suspects out of their Constitutional Rights. That's all you have to do is politely say NO and then KEEP YOUR MOUTH SHUT. Rambling on will not look good. If pressed, that's all you need to say is "I want a lawyer". Otherwise KEEP YOUR MOUTH SHUT. "No" "I want a lawyer" Is that so difficult?

    This is actually a good move if you're in the state of Michigan. Under Michigan laws.

    From what I understand.... it's not illegal to disapprove a Field Sobriety Test.

    What the officer will say is... you will need to get a test done at the station.

    This gives you about another hour to sober up... by the time you get down to the station and paper work is drawn up.

    If you disallow this test... it is punishable by law.

    Basically it's just a stall tactic on your part... hopefully you pass at the station.

    To clarify, sobriety tests are ONLY REQUIRED when there is BODILY INJURY OR FATALITY. Under a routine traffic stop you are NOT REQUIRED to submit to a Field Sobriety Test. Yes, the police can put handcuffs on you and say that your license is suspended. But your attorney will have a field day in court when the dufus cop and prosecutor try to convict you on "smell of alcohol" alone. It is really alarming that the average citizen does not know his basic Constitutional Rights. And it is appalling that cops are diligently trained to coerce citizens to give up those rights. NEWS FLASH: The cops are not your friends. They will try to coerce and intimidate you at every turn. "Be honest with me and I'll treat you fairly" is the biggest lie a cop will tell.

    While you think the longer you delay, the more sober you become might be right, but your BAC will be higher
    the longer you wait. It takes a while to get from your stomach to the blood/ lungs.

    Listen carefully to the cop. He will ask when was the last time you ate and when was your last drink.
    If you tell him over a hour ago, he will test you right away, because that's how long they will have you doing
    stupid shit.

    Eating and drinking water before driving helps you, being pulled over or not. The sooner you can get that cop to
    test you the better.

    Don't drink and drive, but if you do, stop drinking about an hour before driving. Drink water and eat something.

    Are you a DWI Defense attorney? You sound like those idiots who get people into a lot of sh!t with police and end up paying a sh!t load of lawyer fees, court fees, fines etc.

    Refusal is automatic arrest. Why refuse if you're innocent? Just to prove how much of a dikk you are? If you're guilty and refuse, a blood warrant is issued and you're caught.

    My advice is just cooperate and if you're innocent, you get to go home, who wants to go to jail, if you're guilty, and you play it cool, you might get the cop to put in a good word and the jailers might hook you up with some food.

    My friend was a wannabe constitutional scholar dikk like you. All cops do is laugh at people like you and him cuz cops get an issued portable pocket sized constitution book and are frequently tested on the constitution while all you did was read some internet sites about your rights lol. Anyway, I got a warning and was issued a citation. He was arrested lol. All I kept thinking was dumb@ss.

    The cop said to him as he was being put into the patrol car. Your friend was respectful and cooperative and gets to go home. You had to be a know it all punk and you're going to jail. Think about that while you're calling your mom to bail you out lol. I was fukkin buzzed and stoned lol. He went to a sh!tty cold and cement cell while I went home and rolled a fat one lol.
