    William Hill Suing FanDuel

Bookmaker William Hill suing FanDuel for lifting passages used in sportsbook betting guide

    David Purdum

In a civil complaint filed Tuesday in federal court in New Jersey, bookmaker William Hill is accusing competitor FanDuel of copyright infringement in regard to a betting guide being distributed at the Meadowlands Racetrack sportsbook.

William Hill, which operates the sportsbooks at Monmouth Park racetrack and Ocean Resort Casino in New Jersey, is seeking damages and injunctive relief after discovering that FanDuel's betting guide included identical wording from parts of the "How to Bet Guide" published by William Hill on June 5, 2018. FanDuel opened the sportsbook at the Meadowlands in mid-July, when it began offering the betting guide in question to customers.

The complaint highlights several sections of FanDuel's guide that appear to be identical to William Hill's, including a paragraph that reads, "Alternate & reverse run lines are propositional wagers offered by William Hill on each baseball game."

"FanDuel's unauthorized copying is perhaps most evident in the fact that FanDuel actually forgot to remove William Hill's name when printing the Infringing Pamphlet," the complaint alleges.

In addition, the complaint claims that language on websites controlled by FanDuel also is copied from William Hill, which cited eight articles as examples.

"We are not litigious people but this is ridiculous," William Hill CEO Joe Asher said in a statement to ESPN. "If the court finds in our favor, a portion of the proceeds will fund scholarships for creative writing programs at New Jersey universities."

FanDuel, citing company policy, declined comment.

FanDuel, which was purchased this spring by European bookmaker Paddy Power Betfair, has had to deal with multiple controversies since it opened its sportsbook at the Meadowlands. In September, after initially refusing to honor wagers placed on erroneous live odds on a Denver Broncos-Oakland Raiders game, the company ultimately decided to pay out more than $130,000 to customers.

I hate the fact that FanDuel & DraftKings both distanced themselves from sports betting for Sooo long claiming their product was in no way related to gambling, and now here they are reaping the rewards from it.

Did Will Hill at least call them and say, "WTF" though to see if FanDuel would change the pamphlet? Sometimes a simple cease and desist will do wonders. Maybe they did and FD gave them the finger, but I just don't see what FD has as a defense unless they want to try and argue fair use "for educational purposes", but will still cost you time and legal fees.

Fanduel the source of all bad press in NJ so far.

Started off with stupid rip off levels of vig first week.

Refused to pay bets after an error and embarrassed/upset the entire local industry.

    Steals content from local competitor.

How dumb would you have to be? Just take it from someone not in direct competition in NJ if you are too lazy to write it yourself from scratch. And if not, at least bloody proof read it before sending it to a printer!

    These guys can't be trusted.

This is rediculous, it's like Ford suing Honda because both manuals say "turn key to start car".

It's more like Ford suing Honda for printing "turn the key to start your Ford" in their Honda manual, which proves the source of all the other identical phrases in the manual.

If its that big of a deal, just have them make a new pamphlet. CEO of William Hill is a liar and is only doing to hurt another competitor.

Did you miss where the Fanduel pamphlet still had William Hill in the text?

I’ve been to FanDuel a bunch of times now. I’ve also been to Vegas many times. The amounts I see people betting on a consistent basis at FanDuel I’ve never seen anyplace else. Just normal guys on line placing thousands on games on a Monday afternoon. They are getting all of NYC and North Jersey action which has a huge amount of money.

I hate that there is no odds board at FanDuel. They have TV screens with partial listing of games that rotate from page to page. Have to look at their app on my phone to see the current lines before going to the counter.
