It appears that the additional loan clause was fully intended to prevent subsequent obligations to repay, which a gift doesn't even give rise to. It seems to me that not only should cs4 not be penalized but his payment from gifted points should count as well.

Give him this one little benefit of the doubt. At least he just lost them in poker rather than in the sportsbook. He didnt actually ask for a gift, he asked for points that he felt were owed to him.

The above wasn't a stipulation or an additional term; it's clarification on what constitutes a loan. You have a history of calling a loan something else to try to dance around restrictions (like an 800 point "poker stake" from no1home), and to prevent you from doing the same song and dance by calling it a gift, that clarification logically follows as necessary to prevent you from taking out a loan.

Tizzy is welcome to give you a gift, as are others...gifts are permitted. However, as I said before, they need to be cleared by me to ensure it's not you trying to work out a loan via PM disguised as a gift. The clarification wasn't ambiguous at all, and you had no protest at the time; instead, you just went ahead and did whatever you wanted and hoped it wouldn't be enforced, as usual. In the future, a simple PM before receiving the gift will prevent any confusion and penalties.

I don't think I'm in the wrong here; world of difference between trying to change terms for payback or ignoring stipulations and elaborating on what "no loans" means. Interested to see what other lenders think though.

You'll have to forgive me if I don't take advice on terms from a guy who can't remember to pay the thousands he owes others...

As I mentioned above, I don't consider it an additional loan clause, but a logical and necessary explanation of "no loans". Gifts are welcome of course, but based on his past (calling loans stakes or gifts) some level of oversight is necessary to prevent him from scamming another loan. The only reason the points sent to me don't count is because they were sent back to tizzy, as I'd said I would for any loan before.

There was no doubt in CS4's mind he was going against the terms as explained above, hoping it wouldn't be enforced or to claim he didn't think it was part of the terms. However, I understand the sentiment that the elaboration is a separate term (although I don't agree with it), and in this case the guy who sent him points is a standup guy. If Tizzy confirms it's a gift and not a loan, I'll cut CS4 some slack even though he tried to pull a fast one...IF AND ONLY IF CS4 explicitly agrees that gifts must be handled as explained going forward.
