Anyway, on to other matters. I've worked out that the latest David should receive his Freedom of Information document is on February 25th. Presumably it will be sent expediantly, so perhaps a day after this. David sent his request on January 28th, and as stated by the Gambling Commission: "we aim to deal with all requests ... no later than 20 working days in line with the statutory requirement."Comment -

Huge thanks to Shari and everyone else for their efforts thus far and for the energy and momentum you've all created. I see Shari's creating a list of people who are owed money - here's my info:

Amount owed: £2,627.01
Withdrawal request placed: 11th Oct 2013 (for £2,000; a second request for the remaining £627.01 placed early December)
The most recent Canbet bonus offer email I received was on 12th Aug 2013 for a 100% deposit match up to £500. The most recent newsletter I received was on 13th Nov 2013 for betting on World Cup qualifier playoffs and offering money back specials on NFL and golf. I submitted a county court action (costing £80) in January but haven't asked the court to act yet as I'm currently out of the UK on holiday.
Thanks again for all your hard work Shari. I will keep checking back on this thread for any news. I just signed the UK e-petition as well.

#745I contacted my local MP about the Gambling Commissions failure and one of his lead caseworkers has responded to me asking for more information. The tone of her email is more in the mould of trying to help me get my money back from Canbet which was not my initial intention when contacting them but I will give them a full rundown of my experience and hope that they will put some pressure on the Gambling Commission.

It seems that they had same promotion in August(someone reported recently), September(I take that), October(for those who lost their money in August and September promotion,also someone reported here). Of course that they knew what is happening, no one who have betting company is not so stupid. Big money missing here because it is not possible that all players who took bonus was successful, someone must lose his money. Here is reported only about 8000 Eur payout, and now we see that reported owed money is over 500.000 Eur, that difference is so much big to not be realized from their side.Comment -

Explanation of exemption applied – section 31
Section 31(1)(g) of the Freedom of Information Act 2000 (FOIA) (‘Law enforcement’) provides that information held by a public authority is exempt if its disclosure would or would be likely to prejudice the exercise of a public authority of its functions including “the purpose of ascertaining whether circumstances which would justify regulatory action in pursuance of any enactment exist or may arise” (s.31(2)(c)).
Section 31 is a qualified exemption so we are required to consider whether maintaining the exemption is in the public interest.
In favour of disclosure
There is a legitimate public interest in promoting the accountability and transparency of public authorities. There is also an interest in highlighting instances of non-compliance within the industry in order to promote compliance from other operators.
A large number of people have been affected by the failure of Canbet to pay its customers.
There is also an interest in the public understanding how the Commission investigates matters of non-compliance and that if there are any failings in this process that these are exposed.
In favour of maintaining the exemption
The Commission has provided updates regarding this case via the Commission website.
The information requested is in relation to a very specific case so disclosure would not be of general public interest. It is of interest to those directly affected by the current situation.
Disclosure is likely to prejudice the Commission’s ability to investigate such matters in the future if the bodies it regulates feel they cannot be candid with it regarding its regulatory investigations. This is not in the public interest as it would have a negative impact upon our ability to carry out our statutory functions.
The case is still currently ongoing and disclosure would prejudice the Commission’s ability to engage with the operator.
Weighing the balance
Having considered the balance of the public interest, the Commission is of the view that disclosing this level of detail would be likely to negatively impact on the openness the Commission expects from operators. The balance of the public interest lies in operators being encouraged to make timely and frank submissions to the Commission when incidents occur to allow the Commission to take appropriate steps in a timely manner.Comment -

#764After the past few days, I don't think this is as big of a setback as we would've thought it would be. We now know who conducted the audit so although Alex has already tried, I'm going to give it a go and contact PricewaterhouseCooper on Monday to see if they'll release the report. As I have maybe 5% chance of that happening, I'll also contact ASIC to see what additional docs I can purchase re their receivership.
Even if that all fails we have enough at this point to go forward anyway. We have the timelines of the bonus offers and few payouts, Peter and Graeme admitting the other day they were trading while insolvent, a much larger amount of money involved than we'd first had when I spoke with the lawyer and ASIC and now even Racing Vic has jumped in. I also assume that if ASIC were the ones to request the docs from the GC they'd comply and ideally we want ASIC to take the lead as much as possible anyway. They have the power and resources to do much more than we ever could to get your money back (as well as throwing these two in prison) and it'll save you guys the legal expense. Hopefully another article or tv piece will come out this wknd/early next week and until I can talk to PwC and ASIC on Monday I'll keep recording names of who is owed and responding to the media. The GC may not want to work with us but many others do and Peter and Graeme gave us a massive gift with their latest statement.Comment -
