#38Sam Bassett, a criminal defense attorney in Austin, says this case is fairly complicated.
"Texas does have a self-defense statute that's fairly pro-self-defense. There's no duty to retreat in a situation where you're defending your habitation," said Bassett. "So there's a lot of layers to this because you have habitation issues, you have the tempers, you have the size of the people involved."
However, Bassett does point out that Christina Bassett was not being threatened physically.
"There was no verbal provocation of deadly force. And then he did leave for some period of time and then came back into the situation with the firearm.
And the close contact between the two of them certainly made it much more complicated and much more difficult to analyze," said Bassett.
Bassett, who is not connected with this case, says the families’ history with each other will likely come into play, adding it’s a "coin flip" whether Carruth will even be prosecuted. If it does go to trial, he points out prosecutors will have the burden of proving this was not self-defense.
Meanwhile, Chad Read’s widow, Jennifer, has filed a petition seeking custody of Read’s children from their mother, Christina.
No arrests have been made, but the shooting remains under investigation by Lubbock Police.Comment -

If the father of kid would have just stepped off the property like was told many times - he could have continued to yell for his son all he wanted to from the sidewalk.Comment -

Also, it wasn’t the shooter’s property. It was his girlfriend or fiance’s property. He was just visiting.
This could get ugly if it goes to court

The main issue is of the dead guy will be considered a trespasser legally, if the killer isn't the property owner it will matter if the killer was acting as agent for they property owner - which it seems like he was since he not being charged for so long.Comment -

Killing is never good and killing people is even worse, but can't bring people back to life by getting revenge or justice or whatever the government tells people they doing for them to keep them safe - the government in every country is literally in the business of selling their citizens a false sense of security in exchange for their taxes(protection fees).
If individuals did not have the absolute right to defend themselves and their property from intruders, they would be forced to accept the role of victims each incident and hide hoping the police arrive in time - 2nd amendment allows for the chance of people protecting themselves, without it the government will always have the monopoly on use of force.
Having killers live in the community is not a happy thought, but realistically people kill people in our countries regularly, whether legally or illegally - lots of killers already living amongst us, not much else can be done about it except be vigilant and aware and always try to choose the safest way to live including being ready to act in self defence as well.
I doubt the killer will get convicted or even get charged, but I could be wrong.Comment -
