#73Got it thanks. In the meantime i received the following from IBAS.
Dear Mr xxxx
I write further to your telephone call to this office last Friday.
I have spoken with my CEO Chris O’Keeffe and he said that he is having a meeting with the Gambling Commission this week and said he would discuss with them if this was something that IBAS should look at, or whether it is maybe a regulatory issue.
I will respond to you accordingly by the end of the week as regards our position.
Regards
Danny Cracknell

Looks like they are having second thoughts about it. I have drafted your complaint but it has to be sent on an "official adjudication form" which I need them to send to me first.Comment -

#75We will include everything, including all the correspondence you have had with 10Bet.
If IBAS come back and say that they cannot adjudicate, then we have exhausted the complaints procedure which means that the regulator (UK Gambling Commission) will be able to look at your complaint directly, which IMHO, is probably better for you.
I know it´s not easy but you will just have to be patient. If you want, you could maybe try one more message to 10Bet (including your email/attachment) - let me know and I will email you something.Comment -

Aside from this, their ´defence´has been that the funds were not able to be debited, which you are able to show is not the case.
It might be worth one last try directly with them.Comment -

#95No, not yet.
Still waiting to hear from IBAS.
I have to say that I am more hopeful than I am confident. If it wasn´t for the issue of the wrong telephone number, I would be very confident that you would win this case. 10Bet are almost certainly going to say that they locked your account because of the wrong details being entered. Whilst this has nothing to do with the issue, it does bring in an element of doubt as to your credibility for the adjudicator, who will probably be looking for a reason to side with the book.
If I don´t hear from IBAS by Monday morning, I will give them a call. As I mentioned, it might be better for you if they say that the won´t adjudicate.Comment -

#98Dear Ivan
As we explained you before, the problem with your deposit was the fact that the deposits were not captured through the *********** company and we were not able to debit it.
Our accounts department tried to contact you on the phone you registered with for the last few days and there was a message saying that the number does not exist (0038167...21.), only after we have emailed you again today about this issue you came back to us with a different number and you did not mention why did you register with a non existing number.
We will contact you in the next 24 hours so you can answer some questions regarding this issue.
You can contact IBAS and file an official complain as they are our arbitrators.
For any further assistance please do not hesitate to contact us.

#99In one of 10Bet emails to you, it appears that you have already acknowledged that the mobile number you gave them was not correct.
As such it is probably too late to activate it and say that this was your number all along.Comment -

#100IBAS confirmed today that they will not adjudicate this and have basically passed me on to the Gambling Commission.

IT WOULD APPEAR MORE A REGULATORY ISSUE AND NOT WITHIN OUR SCOPE, SO P0SSIBLY SOMETHING MORE IN KEEPING WITH WHAT THE GAMBLING COMMISSION OFFERS. ALTERNATIVELY IT MAY FALL WITHIN THE REMIT OF THE REGULATORY BODY WITH DEALS WITH THE COMPANY CONCERNED.
GENUINELY SORRY WE CANNOT BE OF MORE ASSISTANCE IN THIS MATTER.

I have contacted the Gambling Commission, their website has a complaint form but it is insufficient to give them all of the information/attachments that you will need to. Will advise as soon as I have something.

#103I thought 10bet were no longer members of IBAS, anyway? Did they re-enrol with them after letting their membership lapse earlier this year?
Good luck with the Gambling Commission. Regarding the mobile phone issue, can you not argue that it's irrelevant to the issue in hand whether/not the number was valid? The core issue from the e-mail included in post#98 is that they say they didn't debit the funds at all in the first place. If you can show via bank documents that they took the funds and then refunded after you requested a payout, then the mobile phone number is a side issue.
Sure, 10bet tried to call you and couldn't, but there's an argument to be made that 10bet can't use that as a reason to deny you made a deposit your bank can confirm you made. 10bet might try and use it - invalidity of contact info - as a new reason to try and keep your funds, but one might argue that this should fail too, if at the point in time at which they make that argument (have they even made it yet? or do we just fear they will?) those contact details are valid, as they are now. Otherwise, 10bet would be able to retroactively take advantage of a reason they didn't know existed at the time they locked your account. Perhaps a slightly hopeful argument, but it would seem inequitable to allow them to take advantage of the phone number issue to keep your funds.
I would try and keep the 2 issues entirely distinct in your submissions to the Gambling Commission. If you get the right of reply to any counter-submissions 10bet can make to the Commission, then perhaps you could leave out the phone number issue entirely from your first set of submissions and address it if and only if 10bet themselves raise it in their counter-arguments.Comment -

#105I received a reply from the Gambling Commission, but it is not good news:

Dear Mr xxxxx
Thank you for your email dated 7 December 2009.
The Gambling Commission is unable to investigate financial transactions. If you think you have an actionable case against a licence holder you should seek independent legal advice. We do not give legal advice on this or any other area.

It is hard for me to believe that neither IBAS or the Gambling Commission are able to investigate a case like this. I will ask them both to reconsider but my guess is that I will get nowhere.
If SBR are unable to help (as appears to be the case), short of actually taking legal action, the only other way to go would be to advise the sites where 10Bet advertise (oddsportal.com betbrain.com). Oddsportal, I know have been known to complain on players behalf.
