    Can I do this?
    and get away with it.

Is there anyway i can go to a retail store and buy the same ps3, and return my broken ps3 in the new ps3's place?

Also the serial number is on the box to, do you think BestBuy always opens the box and checks the ps3 serial number?

The problem is my ps3 keeps freezing, and have to reboot many times during the day.

You can try but probably won't get away with it. I can't condone this behavior, its so dodgy.

I've already done it at Kmart. I wasnt swapping old for new like you, I was returning the new one, just wasnt happy with it. But the premise is still the same. They did open the box and verify all the components were there, but they didnt verify or even check serial numbers or even unwrap any of the components to make sure they were intact. I've heard Bestbuy and Target are much stricter. But at Kmart and you should be fine. Those employees making $7.25 didnt give a shit. The key is just package everything perfect and make it look as unopened and as new as you can. Wait 2 days and return it. Reason for returning: You saw it cheaper online.

Yes they do care. Because there will be someone in charge that will find it later and there will be hell to pay for one that did it. And some just don't want to let someone get one over on them.

I was at Future Shop the other day (A Best Buy owned store) and a girl was returning a PS3. The girl working the desk caught the serial number right away. The one returning it said she must have grabbed her boyfriends by mistake. Yeah right.

Can you get away with it? Yes but its slim.

so there is a serial number on the box and on the ps3?
just return their box that has the correct serial number, and on your ps3 Im sure you can make a fake tab with the correct serial number

oh yeah and what you are doing is wrong

There should be a law on the books making the above act a crime.

                                    Its no different than shoplifting.

You could probably get away with it, but it just means someone else is opening up a broken, used PS3 which is pretty messed up.

Like I said in my post, Bestbuy companies are much more strict and I wouldnt recommend trying it there. I've done it at Kmart, and Walmart, so I have first hand knowledge of this (once was at kmart for a ps3 that I wasnt happy with, once with an Xbox360 that got a red ring 3 days after I bought it), so both times it was the actual system I purchased, but like I said they didnt check serial numbers. They even called up a kid from the Electronics Dept to take a look and make sure all the components were there but the never checked serial number or even opened any of the individually wrapped components.

I dont recommend doing what OP is suggesting either, I'm just answering his questions. But just FYI, anytime a game console is returned, defective or not, it is returned to the manufacturer for repackaging and any necessary refurbishing. So another customer should not be buying his returned console. It is possible though that a store clerk doesnt follow protocol and restocks it on the store floor.

might be able to get away with it at wal-mart easier. youll most likely just get store credit on it no matter where you go.

Its still hit or miss. My wife worked at there when she was a teen. She hated the dumb shit people would try to pull and enjoyed stopping it.

Work or not its kind of a dirt bag move. Now if someone bought a extended warranty and was screwed over for a real claim then I can see doing this (to the store that screwed that person out of the claim).
