Got pulled over last night and being charged with a DUI

    No, I believe in giving a chance. Only one. However even if it is your first offense and you hurt people you should be punished. The point of this argument is, my point anyway, you drink and drive and get caught you should be punished, and if it is multiple offenses you should be punished severely. These people that do it over and over and over they are despicable and will eventually hurt somebody the odds of that happening is great.

      Im truly sorry for your loss however a .06 is = to you having a steak merinated in wine and driving home. If they were .06 there was probably alot more to it then just the alcohol.

            no one's ever played with a breathalyzer? mom got my brother and i one each several christmas's ago (her: so you're careful. us: bet you i can get higher tonight!) and i experimented a lot.

            thing is, anywhere from .06 - .13 or so is really, really hard to tell where you're at. above or below that range you can tell, but in that middle gray area, it's tough.

            also, tony: "i'm truly sorry for your loss but ______" is pretty ******* bad. you should probably stop.

              Actually a 12 oz beer consumed by a 100 lb person will register .04 after one hour. This is approximate value via a chart I just found. So I find it doubtful that eating marinated steak will give you .06.

                again you have never had a drink so you dont have any idea what imparment is. Do I know what .06 is Yes I do. Its about the same as coffee. Less then talking on a cell phone while driving.

                  Nobody can begin to understand your pain and I'm truly sorry. But there has to be more than alcohol that caused that crash. Likely texting or just bad driving that would have happened without the alcohol.

                    Listen I understand I lost my uncle to a DRUNK DRIVER so I understand. I have gotten over it forgiven the fool. However there is a huge difference between being DRUNK and having some alcohol in your system.

                      PA is running ads right as we speak about buzzed driving and how it impairs your abilities. Even the slightest impairment can lead to an accident. I don't know how you guys can argue this, I really don't.

                      Yes, everybody is different but they are proving that impairment comes with just a slight buzz. Not worth it in my book. I don't drive even with one drink, I just avoid it and you can too. Not that hard when you consider the consequences.

                            I will continue to have a couple beers and drive. I have a breathalyzer with me at all times because I cannot afford another one. At no time have I condoned drunk driving. But if a friend came to me and told me he drove drunk last night, I wouldn't tell him to call the police and ask to be arrested.

                              I can't begin to tell you how I sympathize with you. Also kudos to you for learning from your mistake. We all make mistakes, what do we learn from them is the question. Why these guys don't understand that impaired driving is serious and seriously dangerous I will never understand. To think that my family and all of us are on the road with these same people.

                                If I understand the OP though, he did not take any sort of field test or breath test ... any good lawyer can make a case for why he looked a certain way on the video unless he was acting belligerent or falling all over himself.

                                I know a person who plead guilty to a DUI because the lawyer said the tape was not great even though they did not take any tests.

                                I know someone else had a clean video and didn't take any tests and got off with nothing.

                                I know not taking the test is "admitting guilt" but I don't see the point in blowing if you have any sort of question about whether you're drunk or not. As mentioned by many before and by anyone who knows a lawyer, not blowing does give you the wiggle room for a good lawyer to make a case to help you out.

                                The speeding part of this is really what fukked this guy though. Shouldn't even have been pulled over if he was going the speed limit.

                                      Don't waste your money on a lawyer if its your 1st offense. The lawyer feel will be a lot more than the fine. Just use the court appointed attorney unless you know a good lawyer that will get charges dropped.

                                        I can accept death it is inevitable and I don't have a problem with it. I too am not a fighter and I too will use a weapon without blinking an eye to protect my family. You can interpret that however you please.

                                                          if "most everyone" would mean more than 1/2 the population above 21 - then i think more than 50% of MALES have driven a car at .08 or more. if you include females then i think you would end up below 50%.

                                                          if you don't agree, then ask 20 random guys in their 30s, my guess is that almost all of them would admit they have driven a car after more than 2 drinks.

                                                            PM if you want legit advice. I'm a lawyer, and been thru this with several people. Depends on what state you are in...and ADR (alternative dispute resolution) is usually an option, and that will leave your record clean in one year. Involves paying a fine (likely around 2500/3000) and community service...and you are never convicted or charged in court.

                                                                Month ago at 4am some drunk sob knocked down three palm trees in from of my house and t boned my girl friend`s car (total loss, he was in one of those old Reading service trucks), and knocked down half my fence

                                                                then the SOB took off..fortunately a neighbor saw him and there was no denying it the next morning when my friends car paint was all over his truck

                                                                He could just as easily killed someone!

                                                                FUK DRUNK DRIVERS!..not cool at all

                                                                (not talking about author of this thread, I`m talking bout these drunks who drive hammered)..

                                                                My grand daughter drives her tricycle on the path this SOB plowed down ya dig?
