    Got pulled over last night and being charged with a DUI
    I am so fvcked

    Pulled over for 29 over on the inetrstate coming home from the bar i stopped at after work. Only had 3-4 but did not take any tests or answer any questions because i wasnt going to risk it. So now i got court at the end of March. Havent talked to an attorney yet but im going to pay loads of money to get out of this.

        how are you being charged with a dui if you didnt take any of the tests? also isnt that automatic suspension of your license if you refuse to be tested?

          im in illinios and im not real clear how it works. it looks like you lose it for 12 months but i havent figured out if it would be a dui also. i think refusal to test is the same as failing. i will clear that up monday with an attorney

                  you werent arrested? i was unaware you could just refuse to be tested for alcohol and then just drive off no questions asked

                    The officer should have informed you of that. If they didn't, let the lawyer know. Any priors?

                          In Alabama if you take the sobriety test and fail you lose your license for 12 months.
                          If you refuse the test its 90 days.
                          Makes alot of sense I know.

                            Lawyer it up. I hope for your sake no priors, I would imagine you would have mentioned them if so. The whole thing will cost you about $2k. You will lose your license. By refusing to take the tests you are automatically guilty, no point in fighting it. He will probably try to charge you with other things too (reckless driving, speeding ticket, etc.) the lawyer should get rid of those.

                            It will suck and it wil lbe tough but you are in their game now make no mistake.

                            Oh and do it again and you will be in the clinker brother. Remember that and good luck.

                                  why did you refuse if you only had 3-4 drinks. you would have been around .08, probably less if you weigh a normal amount and they weren't drank in like a half hour.

                                          If you didn't blow or take any field tests, any lawyer gets you off with little effort. It's pretty simplistic if this is the actual case. There is no evidence, there is nothing to prove you even had a drink other than what the officer said.

                                          And agreed with above, you always refuse to test if there is any question of your sobriety. A good lawyer can pick apart these sort of cases - but if you blow and you're over, you're fukked.

                                                  This is pretty accurate. If you did not answer questions, or let him know you had been drinking, he really has no support for his claim of you driving drunk. A good lawyer that is well into the system will get you off for a couple grand or more, which is what you would have paid in fees/court costs if you do get charged with it. With this court system its really a game of cat/mouse. All the lawyer know the judges, clerks, cops , etc. Instead of charging you with it he can convince some people (using more than just words) to let the case drop on account of no evidence, and everyone gets paid, it does not go on the record books.
                                                  You will have to do something about that speeding ticket though, anything over 20 mph past speed limit is wreckless driving. that may be a whole different story altogether.

                                                      i was arrested after refusing to take sobriety test. i was taken to the station processed and released on $100 bond. i didnt know the speed limit was 55 until this morning. i take the route to work and i thought it was 65. either way i got pulled over on my exit ramp 5 mins from my house. i speed up to blow by a line of semis and cars so i knew i was ****** when i saw the cop.

                                                      As for drinking, i got off at 2 30 in the afternoon and headed over there until i left at 8. i didnt drink for the last hour but the drinks were on the company so take it at that.

                                                          I got an open intox in vehicle last week cuz I had a fifth in my backseat that had been opened the prior weekend I forgot about. Couldn't believe the cop wouldn't give me a break on it.

                                                                    Good call not taking the tests. Any lawyer can get you off or at the very least limit the damage. Most likely you'll just get fined and maybe a drivers ed class or something minimal
