She was robbed while working the cash register at her supermarket last week. The bum gave her 3 blows to the face, and roughed her up pretty bad. They had a preliminary trial today to see if he can be tried for aggravated robbery. The judge said there was enough evidence to warrant it. I was really proud of her. She testified in front of the deadbeat while he was sitting at the defense table. God, I wanted to beat his ass to a pulp, but it looks like he'll be getting 12-20.

I don't know what will happen with the grand jury. She has vision problems now, but if they improve he might get regular robbery which is 6-9 years. Of course, I hope her vision gets better. We checked out his rap sheet on the Nashville city website, and he has been arrested about 25 times since 1987 for anything from possession, shoplifting, assault, robbery, and driving without a license. He's 49 now, and I think its safe to say he isn't planning on changing his ways anytime soon.

The prosecuter told us that there has to be proof of bruising, or permanant damage for it to be aggravated robbery. She had some bruising after the incident, but the detectives did not take pictures of her. The swelling has gone down since then, so there isn't any physical proof. There is a videotape of the incident, but the statute in Tennessee still states that physical proof on the victim must be provided. Its really f---ed up if you ask me.

On another note, have you sat your wife down and explained to her that no money is worth her getting hurt, meaning don't block the cash let them have it. Who knows if he had a gun what would have happen.

Had a friend years ago refuse to give the money to the robber it turned to a fight, long story short he lost his job because he didn't follow store policy of hand over the money.

He will only be sentenced to 1/3 of the max penalty and then with good behavior he will likely only serve 2/3 of the time he is given and will be paroled.

He will be back on the streets in less than 5 years.

It is insane that we keep letting these people out. The guy is almost 50 and been in jail about as long as out of jail. Just say enough is enough and keep the bastard behind bars. Sorry to hear about your wife man but she should feel good about doing the right thing in court.
