How is Fanduel and DraftKing and Officefootballpools legal?

If someone who runs office pool privately can be charged? Almost everybody does it but when some individual does it on a big scale they get charged. i just came across this story http://www.nj.com/sports/index.ssf/2...busted_an.html where a teacher got busted for running a big survivor pool with nearly 10000 entrants. If what he did is wrong then how come sites like officefootballpools are legal? Above all how is fanduel and draftking which are worse than books when it comes to vig legal. Fanduel and draftking hide saying they just do fantasy sports and there is no gambling but the thing isthey are the worst because they rake crazy and they pay out to almost half the participants in each tournament making the participant fee llike they are winning and to make them continue to play so that they can rake them till the last penny.

1k? He had close to 10k entrants on the year he got busted.

If he takes a small fee, why is it illegal? Officefootballpools charges a fee per entrant in all contests....how come they are not busted with millions of players playing there?
