When the United States Constitution was ratified, the speed of communications and transportation didn’t allow for the Federal Government to respond to invasions. So every State Governor was granted the authority and responsibility to repel invasions by using every means necessary, including lethal force. The Biden Administration has not only failed to defend the border, they have actively encouraged the invasion now underway. Texas Governor Greg Abbot has the authority to do whatever it takes to repel the ongoing invasion. The DOJ will lose this legal battle.

What evidence did he destroy? 33,000 emails? had his staff smash his devices with hammers?

No there won't. He will only be "jailed" if he's convicted by a jury of his peer and the conviction is upheld by multiple appellate courts. That's our system of justice.
