It's all about if this "Gawker" has credible business insurance.

Some business insurance tells you MAX CLAIM = $10,000,000 something to that nature.

If they don't have adequate insurance... or no insurance... then this Gawker has to figure out if they should just file corporate bankruptcy or not? If they can prove they were already in debt... might as well file... and then start up a new business. Everyone does it. It's America.
