I'm not arguing against crusher, In simply saying that there needs to be reliance and consideration for the offer to be enforceable. He needs to show he reasonably relied on the offer to his detriment - he has a decent case because he did have 2k in losses which he didn't state in the op.

There was consideration in my book. He put his funds at risk, just as was prescribed. What happened with that risk is irrelevant. It's the risk which the book asked for, knowing that they win that deal X times out of 10.

If he had to lose to get his bonus, then that means that essentially zero promotional offers are legit. That's ridiculous.

Again, I'm not talking about what the law IS around gambling in the state of CT. I'd have to consult a lawyer for that. I'm just saying what it should be, logically.

The kicker is they have agreed and acknowledged that my promotion shows $5000. The terms, however, say differently. This is only according to them. The promotion is gone, over, finished. So how can I even know they are telling the truth. Does it even matter? They should just honor their promotions.

I don't see this as a gaming issues - I see this as a contract issue. A gaming issue would be how a game is graded, how a contest is run. This is more of a contract issue.

I believe Crusherr should win based on the following common law contract analysis.

He accepted a written offer and deposited money, played games, and relied on that offer to his detriment, lost 2k.

A written offer that was reasonably relied on, was accepted, and the consideration was the detrimental reliance on that offer that occurred when the player lost 2k in reliance on a written offer that he opted into.

The gaming commission may be willing to resolve this issue but this isn't really a gaming dispute, its a contract dispute - no different than when you spend 2 thousand at a store and expect a thousand dollar gift card. Common law - state law should control here. I don't see this as an issue for the gaming commission since it doesn't involve gaming.
