Bet-at-Home's Maltese license is not valid in Austria. A regional court in Austria ordered Bet-at-home to pay back 950,000 euros to a gambler that played and lost over a million euros playing roulette with the Malta-licensed Bookmaker.
Bet-at-home does not have a license to operate an online casino in Austria. And according to the European Court of Justice, Austria is not obliged to recognize the company's Maltese license.
The District Court of Linz referred an earlier case against the founders of bet-at-home.com, Jochen Dickinger and Franz Omer, to the ECJ which ruled that without harmonization of gambling laws at European level there is no duty of mutual recognition of authorizations issued by other member states.
The news that bet-at-home.com has to pay back 950,000 euros to a gambler was conveniently ignored by most igaming portals and industry magazines apparently concerned the case could have originated a number of copycat lawsuits with players trying to recover their online losses in court.
But reading (and understanding) the details of the case above, it would have been obvious it was quite unique as the player, a problem gambler that had excluded himself from Austrian casinos, stole the money he lost gambling with Bet-at-home from his employer, who ultimately will receive the returned funds.
