I said "if I go on your property to retrieve a ball or something that went over fence, etc he said he could blow my fukkin head of for trespassing and not a thing would happen to him. There is no way the gun laws are that loose in Texas.

#60as a texan, i know this to be true..
anyone on your property who does not belong is free game and you can shoot.. (fenced, locked property.. not an open front yard or unlocked gate)
remember.. we can leagally carry guns.. just take a class and get a permit.. so the intruder could have one as well.. shoot first for safety..
now with that said, it rarely happens.. most people stay out of your property.. and criminals usually strike when no one is around to shoot them.. lol

Not once have I seen anyone mention the difference between the possible criminal penalties and civil suits. A grand jury could very well no-bill you for shooting someone who came on your property to retrieve a ball, but I seriously doubt it if the shooter can't show how he was threatened. Even if it's no-billed, you ain't walking away scot free.
I can give you an first-hand example of what likely would've resulted in me being charged with manslaughter or wreckless homicide from about 10 months ago. Wife and I head out to go buy a Christmas tree, first weekend of December. When we pull back into our drive 45 mins or so later, there's a dead 4-point buck laying right on our caliche path.
There are about 300 open acres behind our property where there are hunters during deer season. I followed the blood trail up the hill to our fence line, and glancing down the barbed wire fence to the south there is a hunter all decked out in his Carhart camos, 30-30 slung over his shoulder. He's got a gun and he's on my side of the fence. But I can promise you that had I just raised my .38 and shot him, I'd have been charged with some sort of criminal behavior since, A) he was posing no imminent threat to me, and; B) that dead buck 60 yards away would've been ample proof he was simply looking for game he legally shot.Comment -
