1. The Personal Conduct Policy exists for the league to punish owners, executives, coaches, and players for damaging the league's reputation, NOT to provide justice to the women. To say that 6 games is disrespectful to the women is irrelevant: the women had nothing to do with this proceeding.
2. There is no question that the league's reputation is more damaged by things that affect the outcome of the games than things that do not affect the outcome of the games. Therefore, it is *obvious* that cheating, whether through deflated footballs, performance enhancing drugs, or even gambling on games is going to be treated more severely under the personal conduct policy than off the field issues.
3. Drugs and alcohol are covered under the Substance Abuse Policy, not the Personal Conduct Policy, so comparisons to Josh Gordon (who repeatedly violated the policy *after* he was penalized) are irrelevant.
4. As the arbitrator said, no player has ever received more than a 3 game suspension for a non-violent off the field incident. Watson was given 6 games because of how many incidents there were. You can definitely make the case that what Watson did was in fact violent, but the ruling stated the league did not argue what he did was violent.
5. The collective bargaining agreement exists specifically so that the NFL can't make an example out of anybody. If you want to throw the book at the players, you have to warn them you're going to do so. You can't just do it after the fact because you feel humiliated. The arbitrator specifically cited the fact that the NFL had to make up their own definition of sexual assault during the hearing because none existed in either the collective bargaining agreement or the personal conduct policy. You can't just default to the legal definition because Watson was never criminally charged.
6. The league should not appeal this penalty. Right now the story is about Watson. Watson is going to be booed non stop by home and road fans. Defenses are going to make a point of sacking him repeatedly (he took a ton of sacks in Houston). People will cheer when he gets hurt. He is going to be out of football a lot earlier than someone of his talent level would otherwise be. If the league appeals to the commissioner (how did the players EVER agree to a system this hilariously stupid?) and the commissioner gives him a longer penalty, then "Roger Godell sticks it to the players union" becomes the story. The arbitrator cited precedent when crafting the punishment, and gave him double the length of the average non-violent offender. I said before that you could make the case that what Watson did was indeed violent, but the league did not make that case during the hearing and the commissioner does not have the authority to overrule the arbitrator on findings of fact. If he tries to say "yes what he did was violent", I could see a federal court overrule him for violating the CBA.Points Awarded:
