Get the shit out of your eyes and read your OP again you dumb redneck. You are not being sued by the State of Kentucky. You are being sued by Discover. You are not being sued by a lawfirm. You are being sued by Discover, who is represented by a law firm. The fact that the summons was delivered by the sheriff doesnt mean the State of Kentucky are the ones coming after you. In addition to criminal complaints, part of the Sheriff dept's duties are to deliver CIVIL case notifications such as this or when someone is being evicted, foreclosed on, etc. This is a CIVIL complaint, not a criminal one, so you're not going to jail or have a criminal record. But a civil judgement will show up on your credit report and a background check, but again it's not considered criminal. You have 20 days to respond, if you dont the full amount of $3500 will be entered against you, as well as 12% interest anually, plus court costs and Discover's attorney's fees. This basically means your going to owe ATLEAST $4200 after the judgement is entered 20 days from now, then also incur 12% annual interest on top of it. They will negotiate with you and settle for a lesser amount than the $3500 before the judgement is entered against you. They will offer anywhere from 30%-75% of the original amount owed, BUT it has to be payed in full before they withdraw the complaint. So if they offer you to settle for say $2000, then you need to pay them $2000 in full no later than 20 days from now. There is NO WAY they will withdraw the complaint on a promise from you to pay $40 a month or whatever. If that is all you can afford than you are screwed because you will be paying that for the rest of your life since $40/month will barely cover the annual 12% interest and you wil never pay back the principal.
