    Definitely not. Doug Martin was suspended 3 weeks. Since they wound up with a bye week 1, his suspension was week 2, 3, 4.

    The issue is how the NFL handled the case throughout the process and if there was fundamental fairness.

    Judge Crotty writes that the NFL “maintains that the issue of fundamental fairness is irrelevant” in Elliott’s case “because ‘there is no such thing as fundamental fairness review under the Labor Management Relations Act,'” and that the NFL “contends that the Second Circuit determined [in the Brady case] that fundamental fairness was not the appropriate standard for reviewing an arbitral order.”

    Says Judge Crotty, point blank: “That is quite wrong.”

    In English, Elliott actually has a chance to defeat the suspension.

    Non-attorney but I did attend a Holiday Inn Express one time years ago. All cases heard at the federal appellate level are initially heard by a panel of 3 judges pulled from a pool of judges assigned to that circuit (at least a dozen depending on unfilled vacancies). If the 3 judge panel rules against you, you can ask to have all of the judges in that circuit rehear your case (en banc) or you can ignore this option and go straight for the U.S. Supreme Court (SCOTUS). It's difficult to have a rehearing by the whole circuit unless the other judges feel the original 3 screwed up or if it's a polarizing case and they want to make sure everyone weighs in before what they believe will be a review by SCOTUS (i.e. a gun control case, abortion, etc.) to get their ducks in a row.

    Assuming he ultimately loses in the 5th Circuit and exhausts all of his options or gives up, it basically means his case will no longer be heard in federal court in Texas, but instead in Federal court in New York (Giving the NFL home field advantage essentially). The 5th Circuit threw out his case basically saying he filed in Texas too early before he exhausted his arbitration appeals before going to court. The NFL went ahead (I'm assuming after arbitration was complete) and asked for declaratory judgement afterwards in NY (basically asking the Court to say they are in the right ) so that's why it got sent there. It's located in the same circuit that ruled on the Brady case.
