    StubHub is not offering refunds to the buyer. They are giving them 120% in credit, not even offering you your cash back is bullshit. Now as a seller they are taking the cash right out of your account. Also if you are a seller you will now have to wait 5-7 days after the event played to get paid. So if I sell tickets today for a mlb (any sport) game in September StubHub will hold my money and collect interest on it for the next 5 months before they pay me. They will make a ton of money just from that aspect alone

    This is grounds for a class action law suit.

    You cannot accept payment and offer credit solely as return of payment for a product or service not rentered.

    you are right but i still think its bullshit they dont give them a choice.

    right now people can use their money and your gonna tell them nope you have a credit.

    thats wrong, especially since they are taking the money right out of the sellers accounts

    Force majeure is what allows a party to breach without penalty. EX: I'm contracted to sell you 100k oranges at $X, but a hurricane wipes out half my crops. Force majeure allows me to deliver only 50k for $.5X without the other party crying breach I didn't give them 100k oranges and you can't sue me because you had to go to a different supplier for the other 50k and had to pay a higher price for those oranges.

    Not gonna examine every state, but in general if they can't perform, they still have to refund (can't profit from the breach by keeping the money). I paid for the right to see X game played on Y date. If they can't perform because of the pandemic, fine, I can't sue you for damages for not playing the game as long as you refund my ticket (hard to seek additional damages anyway since all you missed out on was entertainment).

    Court of public opinion will make them cave anyway once it gets more publicity.
