Withholding my 32000 GBP for over 9 months with no communication is surely criminal activity?

I know this is pretty desperate but is there anything we could do as a group? Maybe contact some authorities etc.?

Also is there anyone who has received any money from them during about last 6 months?

I don't want to get anyone's hopes up but a player reported being paid around €1000 on Monday.

Once again it appears that Skrill have put pressure on Dashbet to pay this one.

This player is a bit of a special case though. I have never seen anyone so persistent over such a long time. They must have emailed me over 50 times during the last 5 months and that was just to report how many more times than that they had been at Skrill.

No one else I know of has had any response from Dashbet or help from Skrill.

As advised last time this happened, get back on to Skrill and try again. Explain that you know of two other players Skrill have facilitated payments from Dashbet to. And keep at them to do something about their client like this person did.

It's no use, this is the reply from Skrill today:

As explained in my previous email a couple of weeks ago, you need to sort this with Dashbet directly, not with Skrill.

Please reach out to them and also, feel free to reach out to any responsible authority.

    Regards,

I don't really know how to respond to this any futher...

I think you should calmly and politely explain that you do not agree that Skrill is not responsible for their client, and that your opinion is backed up by the facts that at least two other players have been paid out in full following Skrill intervention. One in the last week.

Appeal to them to please try harder to help you like they did with these other players.

I think it would be worthwhile sending a hard copy letter to them as well, to try and get direct to management and bypass customer service.

The last lady paid just would not take no for an answer and if Skrill can find a way to pressure Dashbet to pay her they have the ability to help everyone if they choose to.

I have even tried to escalate this to the Skrill official complaints department, this is their diasppointing response:

    Dear ................,
Thank you for your email and apologies for our delayed response.

As previously mentioned, your case has been referred to the Complaints Department of Skrill for further review and response. We would like to take this opportunity to investigate your concerns and address them accordingly.

    Factual Background

You have been using your Skrill account to make payments to and withdraw winnings from Dashbet (an online sportsbook merchant with whom you had an account). Recently, you have been unable to withdraw your winnings from their website, and the merchant has been unresponsive to your attempts to contact them. You say that you are unable to retrieve your winnings directly from the merchant and for this reason you want Skrill to pay you the amount of 32127 GBP which is what you claim the merchant owes you.

    Findings

While we recognize the seriousness of your predicament and we are willing to resolve the matter to your satisfaction, we find ourselves unable to issue a refund for the said amount of 32127 GBP. Our general approach is that disputes between buyers and sellers should be handled between them as Skrill does not have access to the merchant’s systems and cannot assess the validity of similar claims. Ultimately, refunds and payouts are handled by merchants in accordance with their applicable policies and not by Skrill. In the instance where merchants do not have sufficient balance in their Skrill account, they could and they should refund out of other funds held with institutions other than Skrill. In the unlikely event our company becomes involved in the handling of merchant refunds, those are handled as far as the available balance allows and on a first-come-first-served basis. As it stands, Skrill is unable to process your payout request nor is able to issue a refund at its own expense. For additional information about our obligations as a payment processor, please refer to sections 9.4 and 16.6 of our Terms and Conditions:

9.4. “…Once funds are credited to the recipient’s Skrill Account, the transaction becomes irreversible.”
    […]
16.6. “We shall not be liable for any indirect or consequential losses including but not limited to loss of profit…”

Please note that due to data protection regulations, we cannot provide you with further details about the merchant or our internal investigation. Still, in case you decide to escalate your complaint and/or initiate legal proceedings against the merchant, Skrill will provide any relevant information to the competent authorities upon official request and to the extent permitted by law.

We understand that this response is likely to come as a disappointment to you, but we hope you will understand our position and accept our apologies for any inconvenience caused. If you think that we have violated our mutual contract in any way, you may choose to further escalate your complaint to the Financial Ombudsman Service by submitting this email as a final response received from the business you complain about. Note that you would need to do so within 6 months from the date of receiving this email. The Ombudsman service can be contacted direct at the following address:

    Financial Ombudsman Service
    Exchange Tower
    London
    E14 9SR

    Telephone: 0845 080 1800
    Switchboard: 020 7964 1000
    Main Fax: 020 7964 1001

    For more information please visit
http://www.financial-ombudsman.org.uk and review the attached complaints handling brochure.

    Kind regards,
    Skrill Complaints Department

Is their argument / declaration fully legal and valid? I thought Skrill should carry some responsibility in protecting their customers' funds?
Is it still worth writing back to Skrill with a different argument, or escalating this further in writing to the Financial Ombudsman?

Or is the whole thing now a lost cause...

All they are saying is that THEY will not pay your money out of their pocket. You must have asked them to pay your money rather than asking them to help force Dashbet to pay you.

What they say is reasonable as they have no way to know what Dashbet owes you.

I think you should take up their invitation to obtain a legal representative and they will help with information for a claim case. For the amount of money you are owed it is worth a few hundred dollars to get proper advice and a few letters written for you.

Alternatively you could write back to Skrill and explain that you understand their position and do not expect them to cover your losses but would like them to try to pressure Dashbet to either pay you or contact you to make arrangements to do so. Maybe also ask if they are able to reverse any deposit transactions you have made to Dashbet. But be careful pulling the trigger on doing that as it may invalidate your winnings being owed. I would mention that you know of two other Dashbet clients whom Skrill have helped in this way (if they want the names tell them to email cases@sportsbookreview.com and SBR will give them the account details)

But I think you should do nothing until you have spoken with a lawyer.

I think they have had enough:

    Dear .........................,
    Thank you for your email.

We appreciate your feedback, but we would like to confirm that we have already clearly set out our position in full in our final response sent to you via email on August 10, 2015. Unfortunately, we would not be able to assist you further with this matter, and our internal complaints procedure has been exhausted.

Hence, it is up to you to decide if and to whom to escalate further. For more information, feel free to refer to our final response.

We hope you will find this information useful. Should you need assistance with anything else, do not hesitate to get in touch.

    Kind Regards,
    Skrill Complaints Department

So basically they are not interested. How did the other Skrill customers get their money back, so unfair that I am being preferentially ignored.

The last lady just ignored them saying they would not help and kept protesting and requesting. They blocked her live chat access and said they would not respond by email any more but she just kept going. I was serious when I said she was unique case though as I doubt many people would have kept their cool and determination the way she did.

I'm not really suggesting you try to repeat her 'harassment' strategy but it goes to show beyond doubt that Dashbet do still hold a Skrill account and have/had funds in it and if motivated enough they will pay. I assume they must want to keep doing business with Skrill under the same entity name at this point so think Skrill probably do have the leverage to help victims if thy want to pressure Dashbet.

A happy ending for me - recouped every single penny of my 32k with some inspired betting plus sheer luck over the past 12 months through football (thanks leicester), tennis (thanks djokovic), basketball (thanks golden state warriors) etc. Now going to take my money and run forever. Have closed all my betting accounts and will never touch this area of shady business again. After getting swindled, I deserved this bit of luck and will spend my money more wisely in the future. Good luck to you all.
