Fed court nixes NJ appeal in sports betting case

A federal appeals court dealt another blow to New Jersey's efforts to legalize sports gambling Tuesday, upholding a ruling that the state's betting law conflicts with federal law and shouldn't be implemented.

NEWARK, N.J. — A federal appeals court dealt another blow to New Jersey's efforts to legalize sports gambling Tuesday, upholding a ruling that the state's betting law conflicts with federal law and shouldn't be implemented.
The case was heard by a three-judge panel at the 3rd U.S. Circuit Court of Appeals in Philadelphia, and the state could seek to have the case re-heard by the full appeals court. But Tuesday's ruling more likely means New Jersey's last chance to legalize sports gambling is to ask the U.S. Supreme Court to hear the case.
A spokesman for Gov. Chris Christie didn't immediately return a message seeking comment Tuesday, but in the past Christie has said he would go to the nation's highest court if necessary.
Voters passed a sports betting referendum in 2011, and last year New Jersey enacted a law that limited bets to the Atlantic City casinos and the state's horse racing tracks. Bets wouldn't be taken on games involving New Jersey colleges or college games played in the state. Christie said at the time that he hoped to grant sports betting licenses by early this year, but those plans were put on hold.
The NFL, NBA, NHL, Major League Baseball and the NCAA sued the state last year, and the NCAA moved several of its championship events out of New Jersey, though it later relented.
The leagues said the betting law could harm the sanctity of the games. In a court deposition, MLB commissioner Bud Selig said he was "appalled" by Christie's actions.
Attorneys for the state had attacked the 1992 federal Professional and Amateur Sports Protection Act on several constitutional levels. They argued the law unfairly "grandfathered" Nevada, Oregon, Montana and Delaware, which each had some form of sports gambling at the time, and said the law violated state sovereignty and equal protection provisions and trampled the authority of state legislatures under the 10th Amendment.
In March, U.S. District Judge Michael Shipp ruled that some of the questions raised in the case were novel, but he suggested the best way to change the U.S. law was to get Congress to repeal or amend it.
Tuesday's appellate ruling reinforced Shipp's view.
"We are cognizant that certain questions related to this case — whether gambling on sporting events is harmful to the games' integrity and whether states should be permitted to license and profit from the activity — engender strong views," judges wrote. "But we are not asked to judge the wisdom of PASPA or of New Jersey's law, or of the desirability of the activities they seek to regulate. We speak only to the legality of these measures as a matter of constitutional law ... New Jersey's sports wagering law conflicts with PASPA and, under our Constitution, must yield."

This is going to wind up in the Surpreme Court no doubt. This should be a state to state issue on this. I can see the New Jersey case winning because the voters voted it in just like the marijuana has done. It comes down to the fact the sports leagues are against it even though gambling has a large part of their fan base.

Do sports leagues really fight this, or do they just come out publicly against it for their image?

Jjgold I heard that AC isn't very nice at all.

I am thinking you have the casino lobby behind this and they should know how it can help their business if they made sports wagering legal. I do believe that it has been said that 98 percent of wagers on sports in this country is made illegally. I heard from several people that there's about 10 states that will consider making it legal to do this in their casinos and racetracks if New Jersey can win the case in the Supreme Court. I know there's going to be a lot of states paying close attention to this. It's going to be a battle between the sports leagues, and NCAA against the casino lobbyists on this issue. I even think that Nevada has a stake here to see if they can make it legal nationwide to be able to set up shop online. I do see things changing here and who know how the Supreme Court will rule but I will be very interested in hearing what will be said at their court hearing on this issue. You may get some clues on what will be said on this issue and see what the justices will say.

    Joizey desperate now!

Greedy bastard AC casino owners fumbled their platinum opportunity to get into sports betting previously because they thought the golden goose was already in their possession with easy slot machine pickings. Now that they are struggling the geniuses are trying to lube up & sneak in through the back door.Only silver lining is no other state is willing to put their balls on the table like Joizey.Pray to Jesus their eventual success will allow states like CA,etc. to piggyback.I have relatively easy access to two bordering states. If the moron politicians from my state finally wise up & notice a bordering state is making decent money from sports wagering they will desperately climb on board to balance the always depleted annual budget. My dum dum state politicians finally allowed casino wagering within the past 1.5 years after a bordering state made hundreds of millions in profits for a decade! We could've kept at least 1/3-1/2 of that money in our state coffers since a decent portion of their profits resulted from our residents crossing state lines to gamble in their casinos

What a piece of crap you are man. That is not representative of Jersey at all. Those people aren't even from New Jersey. Learn what you're talking about before you make a fool of yourself.
