THE FOLLOWING ACCOUNT AGREEMENT DESCRIBES THE TRANSACTION TERMS AND CONDITIONS, UNDER WHICH Playing24hours GROUP OFFERS YOU ACCESS TO ITS SERVICES.
I. Responsibilities of Users
In order to become a Member of Playing24hours Group you must register online or by phone. You must also read and agree to the terms and conditions of this agreement as well as the Privacy Policy. The terms and conditions of this agreement are:
1. You must provide Playing24hours Group with valid and accurate information. You must be at least 18 years of age. You will not open more than one account per site. Playing24hours group reserves the right to terminate duplicate accounts or any account containing untruthful information.
2. If you provide credit card information, you agree that we may charge your credit card for all Payments initiated by you for amounts above for any of your then-current Playing24hours Group account balances.
3. If you do not provide credit card information, you agree that you will not attempt to initiate any Credit Card Payment for amounts above your then-current Playing24hours Group balances. If you breach the terms of this paragraph, Playing24hours Group reserves the right to reject your Payment and you will be solely responsible for the consequences of this rejection.
4. If you request funds transfer to your bank account, you will provide an initial authorization in accordance with our instructions.
5. You agree not to engage in behavior that could reasonably be construed as providing yourself a cash advance from your credit card, and agree not to assist users who engage in behavior that could reasonably be construed as providing themselves a cash advance from their credit cards. Such behavior includes, but is not limited to, a User paying someone by charging a credit card, then receiving the funds back from the original Recipient and attempting to withdraw the funds from a Playing24hours Group account. Playing24hours Group reserves the right to reverse all such transactions and to terminate any accounts that are associated with such behavior.
6. You agree not to use unsolicited email, Usenet, message board postings, or similar methods of mass messaging (spam) to gather referral bonuses. The use of spam to promote the Playing24hours Group service has strict negative consequences. We will immediately and permanently terminate the account of any user who has used unsolicited email to gain referrals. In addition, you may be subject to legal consequences under applicable law if you send unsolicited email.
7. You are responsible for confirming the identity of the other party in a payment.
8. You consent to have your name and email address made available as identification.
9. In the event of the loss or malfunction of your handheld device, payments made since your last connection to the Playing24hours Group server may be lost, and Playing24hours Group disclaims all liability for such loss.
10. If you are a member, you agree that all payments initiated by you in which charges are made to your credit card are final. You agree that you will not charge back any amounts previously charged to your credit card by Playing24hours Group. If you charge back a credit card charge for a payment initiated by you, you agree that Playing24hours Group may recover the amount of the charge-back by either reducing your Playing24hours Group account balance or re-charging your credit card for the amount of the charge-back.
11. If you initiate a charge-back of a previous credit card charge, your Playing24hours Group account may be terminated.
12. If you request that Playing24hours Group transfer money to or from your bank account, you will provide Playing24hours Group with an authorization in accordance with our instructions.
13. You acknowledge that
Playing24hours Groups service and Playing24hours Group are not a bank
Playing24hours Group accounts are not insured by any government agency,
Playing24hours Group is not subject to banking regulations. Interest earned through assets is the sole Property of Playing24hours Group.
14. If you do not access your Playing24hours Group account for a period of one year, it will be suspended. After the date of suspension, you will have 90 days to recover your account balance, after which it will be subject to applicable regional laws regarding escheat of unclaimed property.
15. You may not divulge your password to anyone else, nor may you use anyone else's password. Playing24hours Group is not responsible for losses incurred by Users as the result of their misuse of passwords.
16. You understand that Playing24hours Group at present does not service accounts from the following countries: Afghanistan, Albania, Algeria, Armenia, Azerbaijan, Belarus, Bhutan, Bouvet Island, Bulgaria, Cambodia, Croatia, Estonia, Georgia, Ghana, Hungary, Indonesia, Iran, Iraq, Jordan, Kazakhstan, Korea (North), Kyrgyzstan, Laos, Latvia, Lebanon, Libya, Lithuania, Moldova, Mongolia, Myanmar (Burma), Nigeria, Oman, Pakistan, Romania, Russia, Saudi Arabia, Serbia and Montenegro, Slovakia, Slovenia, Somalia, Syria, Tajikistan, Thailand, Turkmenistan, Uganda, Ukraine, Uzbekistan, Yemen, Yugoslavia. This list is subject to change without notice.
17. If you use, or attempt to use the Playing24hours Group service for other purposes including but not limited to tampering, hacking, modifying or otherwise corrupting the security or functionality of Playing24hours Group, your account will be terminated and you will be subject to damages and other penalties, including criminal prosecution where available.
18. You agree to indemnify and hold Playing24hours Group, its affiliates, officers, directors and employees harmless from any claim or demand whatsoever relating to or arising out of the service.
19. You acknowledge that when speaking to customer service agents at Playing24hours Group, your call is monitored and/or recorded for quality and security.
20. You acknowledge that for fraud and security purposes your records are kept by Playing24hours Group even after your account is closed. These records are stored securely and kept confidential.
21. Customers are reminded to print out all transaction data, the Terms of Use, the Privacy Policy, and the payment methods in order to avoid misconceptions at a later time.
II. Responsibilities of Playing24hours Group Inc.
1. Playing24hoursGroup reserves the right to verify any of the information you provide.
2. Playing24hoursGroup shall make reasonable efforts to ensure that requests for debits and credits involving bank accounts and check issuances are processed in a timely manner. However, a number of factors, several of which are outside of our control, will contribute to when the funds are received. We make no representations or warranties regarding the amount of time needed to complete processing, such as delays in the banking system or your local mail service, nor shall we be liable for any actual or consequential damages arising from any claim of delay.
3. Playing24hoursGroup shall not be responsible for payments made to unintended Recipients due to the input of incorrect information by Senders, nor shall we be responsible for the verification of the identity of Users.
4. Playing24hoursGroup shall not be responsible for the privacy practices or the content of third party referrals or web site links.
5. Playing24hoursGroup shall not be responsible for any information lost due to malfunction or loss of a handheld device.
6. Playing24hoursGroup shall not be liable for any damages of any kind arising out of or in connection with this account agreement, the Playing24hoursGroup web sites, or Playing24hoursGroup service.
7. Playing24hoursGroup shall not be obligated to pay User for any Payments for which Playing24hours Group has not been fully paid by the Sender's credit card issuer.
8. Playing24hours Group reserves the right to hold funds beyond the normal distribution periods for transactions it deems suspicious.
9. Playing24hours Group, in its sole discretion, may terminate this Agreement, access to its web site, or access to the service without notice for any reason and at any time.
10. Playing24hoursGroup retains all right, title, and interest in and to trademarks. Users shall only use Playing24hoursGroup trademarks with the express permission of Playing24hoursGroup, Inc. You shall not use the trademarks in any manner that is disparaging to Playing24hoursGroup. Under no circumstances may a User alter, modify, or change Playing24hoursGroup trademarks.
11. Playing24hoursGroup, in its sole discretion, reserves the right to restrict or terminate an account for any one of the events listed below: -Receipt of potentially fraudulent funds -The account has been used in or to facilitate fraudulent activity.
12. Playing24hoursGroup is responsible for keeping your records and personal information secure and confidential. Playing24hoursGroup protects your information from error, loss, and unauthorized access. Our employees who have access to your information are made aware of this and each employee must sign an agreement stating that maintaining confidentiality is a condition of employment with Playing24hoursGroup.
III. Liability and Error Resolution
1. You are responsible for keeping your password and
login information safe and confidential. You should
not share this information with anyone, nor should you
allow this information to be accessible by anyone. If
your password and/or login information is used by an
unauthorized person, you may be liable for any misuse,
damages, or loss incurred.
2. In case of errors or questions about your transactions,
you should notify Playing24hoursGroup through application
messaging or e-mail.
3. You must:
Tell us your account number, password, name and primary
email address;
Describe the error or the transaction you are unsure
about, and explain as clearly as you can why you believe
it is an error or why you need more information; and,
Tell us the dollar amount of the suspected error. If
you tell us orally, we may require that you send your
complaint in writing within ten (10) business days.
We will tell you the results of our investigation within
ten (10) business days after we hear from you, and will
correct any error promptly. If we need more time, however,
we may take up to forty-five (45) calendar days to investigate
the complaint or question.
We may periodically email you notice to inspect your
Playing24hours account history online. If your transaction
history shows electronic funds transfers that you did
not make or authorize, notify us at once. If you do
not notify us within 60 days after receiving notice,
you may not recover any money you lose after the 60
days if we can prove that we could have stopped someone
from taking the money if you had notified us in time.
If a good reason (such as a long trip or hospital stay)
kept you from notifying us, we may extend the time periods.
